This sounds like a really bad idea. the real question is who is on the title not who cosigned at the bank. If shes on the title its just as much hers as his and who was going to keep up the payments should have been addressed in the divorce. I would agree; if I were him I would talk with an attorney. I am certainly not an attorney nor law enforcement, but I would suspect that IF she has any personal items in the car - they could arrest him for theft of property.
