Tame deer charged him and he shot it in self defense.... Case closed....
Probably damaging his property stomping around and eating stuff too. Seriously though, I would think the state would not want that deer out of the pen with the general public, and killing it would be ok. I know in Alaska, we could shoot buffalo if they were across a certain imaginary line that belonged to a buffalo farmer. We never did though.
