federal offense I imagine, no more than $1000 and 6 months in jail. I can't believe the people that think it is worth a try to not have one in. I have been checked at least once a year in the dove field just about over the years and a couple times waterfowl hunting.

actually the federal fines were usually less than the state fines because there is no court cost on a federal fine.

Or a pocket knife to wittle one quickly. There is a hackberry in Kentucky that gets limbed up every Sept 1st when I realize it doesn't have one ...... For a benelli sbeii, the plug needs to be the length of (2) 2 3/4" shells

Don't think most people have bad intent when they get caught without the plug in - just probably never been approached by a GW about this. But it only takes one time to learn this lesson.

Had this issue come up years ago. Did the pencil thing in my 1100 so I could just shake it out easily when not needed.
Got checked on a dove hunt, with the pencil in. Was told by the GW in order to be legal, the gun had to be disassembled in order to get the plug out. Pencil or stick was not legal. He was in a good mood that day I guess, and didn't give me a ticket.

My luck has been so bad lately, it could be raining pussies and I'd catch one with a dick broke off in it.

Why is a pencil or stick not legal?
It plugs the gun. There is no specified requirement for "plug that came with the firearm" to be used. They just say "plugged" or "not capable of holding more than 3 shells."
How the hell are you going to insert or remove a stick/pencil or plug into a magazine WITHOUT disassembling it? You HAVE to disassemble the damn thing to get it in there or remove it.
Maybe game wardens can do that by osmosis.

I got checked a few years ago,wasn't even shooting.standing with my wife while she shot, drinking beer.she has a over and under,my gun was in a case on the ground.he checked our license and the asked "where's your gun". I said right there I'm not shooting. He uncased my gun and asked where's your shells? Got shells out of my bag and starting putting them in magazine, jamming them in like he was trying to break the pencil or stick.been checked a bunch But never like that.jamming shells in like he expected some kind of failure.
