A while back I was going up to my dads and I noticed a couple pilfering around a neighbors fallwn in barn by the road. Acrually I first noticed the girls handmade cart she pulls aroun with her sitting on the side of the road. I stopped and then noticed the two pilfering around the old barn. I told them our neighbor wouldnt want them prowling around on his property. They both came out of the woods and had something they had picked up in each hand. It was just garbage I guess, something they had picked up off the ground, an old bottle or a little piece of scrap or something. The girl said "we were just looking around". I said well you have something that belongs to him in each hand. The guy said"were not doing anything wrong". I said you are tresspassing, you are in violation of the law right now. My point is they really thought it was ok to prowl around on another mans property and keep anything they found laying around. This is the first problem: "We're not doing anything wrong." There is no thought about laws, regulations and someone else's property. It's just "We're not doing anything wrong." Or "We were just riding our ATV/bike/horse on this land no one uses." Or "Our grandaddy knew the owner years ago and we've been coming here for a long time." Or "It's just an old barn with junk around it nobody uses." Trespassing is trespassing, and is illegal. Period. The second problem: It's a continued breakdown in society's morals, lack of parental guidance, and no personal accountability.

Doesn’t matter what they’re there for. Wrong is wrong. If you’re on someone else’s property and it’s not yours and you don’t have permission it’s trespassing. Case closed. Then it goes up from there. A trespasser is a step down from a thief. Not all trespassers are thief’s but all thief’s are trespassers. So in my mind if your trespassing you’re up to no good. I could be wrong, but my guess is you don't have a ton of experience with this. I've dealt with lands that have had absentee landowners for sometimes 50 years. Word gets around and sometimes it takes a few years to convince all the parties that it isn't a free for all. I've had to make some compromises with a few trespassers cause I knew it was the only way to control the flow of more (like granting hunting rights on a small piece). Running in and blowing things up often time will cause more problems in the long run. Figuring out why people are on the place and if you can really keep them off (without the national guard) is a good first step. I stand by my original statement. I WILL NOT compromise for something that is legally mine and I paid for. I don’t care who they are. If it’s not theirs they have NO RIGHT to be there unless granted permission by the owner. I’m not blowing anything up. I’m protecting what’s mine. There is no grey here. It’s pretty black and white.

For an entirely different take on trespassing, in Scotland you have the "freedom to roam", meaning you can walk anywhere as long as you are behaving well. https://www.scotways.com/faq/law-on-statutory-access-rightsThis opens the opportunity for the landless citizens and tourists to enjoy responsibly. I even hiked around on a famous Scottish estate in the middle of the red stag hunting season. All they asked was that I stay on the main roads so as not to interfere with the hunt, as they made most of their money from their high-end guests who came from all over the world to bag a red stag. It's like the whole country is a national park, and allows tourists to see some really impressive places. I'd be cool with that too as long as folks couldn't sue me for stepping in a stump hole and breaking their leg...

However, many times on properties that a person doesn't reside on you have to make compromises to maintain it the best way possible. I can leave my tractors, atvs, and trailers for weeks at a time on places that if I acted in the black and white manner I would have many issues. Plus, making allies with the harmless form of trespassers can really empower them to become a watchdog and give them something to lose. I'm telling you, I spent years banging my head against a wall busting everybody. Now, I strategically use past trespassers to police areas that I would have no realistic ability to control otherwise.

I owned hundreds of acres of great land and outfitted on thousands more.
My experience has been you let them go, you will catch them again...and/or one of their friends. And when you try to prosecute their friends...they will complain how you let their buddy go. people talk and they will let folks know you just let them go.
They WILL use your land whenever they can as there are zero ramifications to getting caught if you just let them go as well as let others know you dont prosecute trespassers.
Also dont complain when trail cams and stands disappear.
I prosecute every single trespasser now. Every one.

Gundoc, I'm sure that the law protects the landowner. The people I met hiking were all well-behaved (the louts were in the pubs). I saw very little evidence of littering or other damage, and people were quick to pick up anything accidentally dropped by others. They were also very mindful of the owner's rights and requests. From what I have seen in the US, I don't think such a law would be workable. There are too many people here who show their appreciation for public access by trashing the place. That's the thing. People in general suck. There are good folks still, but a lot are not and don't respect others or their property. There was a time, folks would care for the the property of others as though it was theirs and if you were the owner, you didn't have to worry about it.

Ok, I'm hearing you AL brotha's. I too have leased land that I had a trespassing problem. When I took it to the sheriff, he knew who they were (never gave me his name), said he'd take care of it and get back with me and then all hell broke loose. Stands gone, cams gone, campers broke into and sheriff was a good ol' boy (New Site, AL). I finally gave up the lease cause I couldn't have anything down there and sheriff wouldn't do a thing about it. Felt like the reports I filed only went in the trash when I pulled out of the parking lot. THIS land I'm on now is mine, not leased, its mine, newly acquired little over 3 years now. Now just to clear up any confusion, when I say I'd pull a gun, it wouldn't be out of anger, it'd be out of fear. Why fear ? First, I'm prob gonna be alone. Second, how'd you get way back here ? 3rd and my main thought, what are you doing that I don't know about and will you hurt me to escape whatever evil you're doing so you don't get caught ? <-- those would be my first thoughts, so your going to see a weapon. Maybe, I dont know, hind sight is 20/20 ya know ??? Shoot man, things can get complicated in the mind when you run up on something like that but I know fear would be there tappin me on the shoulder and that can play a major role in my actions I'll tell ya that. I'm not sure what I'd do. This is the first time I've had any evidence of a trespasser of any kind on my land. I know all my neighbors and I'll talk with them about it I'm sure. I just don't think I'm going to go hunting these guys down. Call the sheriff? was already going to do that just in case there's more episodes or something comes up missing.

Tough spot. I have hunted awesome land that I given up on because the neighbors, who’s land was just as good, couldn’t stay off it. It’s a shame really. Just respect others the way you want to be respected. Regardless of what they were doing there, I’d have to at least have a conversation with them. Picking up arrow heads is a bit different from poaching. It’s still wrong but it is different.
