From what I gathered, he was fishing close to a marina. The guys in jonboat possibly worked for the marina and they didn’t want ppl fishing there. That’s all I’ve read.

So, here's a question..............

I know if you're fishing on a public lake, you can fish around docks and such, you just can't get out of the boat onto the docs. But can you ride up into a marina to fish? Can they legally stop you? How's that work?

It depends on what state it's in. You can't fish someones dock in LA without their permission. It's actually tresspassing.

A copy of this video was just sent to a member of the Al State Troopers, Marine Division. Let’s see where it goes now.

so in places like LA, how close can you fish to a dock? where does it become "private property"?

I don't know that answer.

What DC said. If they work for the Marina, I'd be instructing the "soon to be previous owner" of said marina exactly how I want my name to be spelled when he deeded it over to me after I won the lawsuit. All sorts of stuff to be claimed in this incident, both civil and criminal. Reckless endangerment, assault, physical damage to the boat, I'm sure threats of bodily harm were probably exchanged. Both idiots remained seated during the altercation but if one of them would have stood up like he was trying to get into the bassboat, owner of bassboat could have uttered the magic words, "stay where you are, I am in fear for my life" at which point he could have legally rid the world of yet another dumbazz just as soon at the guy tried to step into his boat. You should always have something more than a boat paddle with you when youre on the water.

The two boys in the fiberglass boat were prefishing for a college TX and the guys in the flatbottom did not like them being on their home turf is what I read. One of the parents has filled charges against the other two men but what they were it did not say. I have read a lot on this on another forum and watched the video many times. One thing I would like to see is the video and audio before it lead up to this event. Was there smack talk or just some ole rednecks pissed because they were fishing their spot. A lot of other questions come to mind also. However, if that were me getting rammed, things would have escalated at mach I speed.

This bullchit goes on at Guntersville Lake around certain marinas, and other lakes.

Public water is public water including the water in, under and around marinas and their docks. Unless there is some other legitimately legal reason AND they can express it or show it, just saying "You can't fish around our docks" is a load of horsecrap.

A lot of anglers don't fight it but it's bullchit unless there is a bonafide legal ruling.

Also, in Alabama this activity by the two assholes in the jonboat in the video would easily have qualified under the state's hunter-angler harassment laws. Not to mention other charges if the guys in the bass boat wanted to have them charged, which I would have.

I don't believe this to be true. Sure, if you get up on their dock and are walking on it, that would be trespassing, but if you are in a boat next to their dock, on public waters, you can fish around the dock and not be trespassing.

Not in Louisiana, which has crazy laws about private property and private water.

So yes, it depends on what state you're in.

Yep. I remember one of the Bassmaster guys getting disqualified in Louisiana for fishing "private" property.

I do remember an episode of Swamp People, shortly after that show started, where one of the guys got permission to fish a "private slough"....they ride up do this slough and sure enough, there's literally a gate across the entrance to the slough....like a cattle gate, hung just above the water, with a lock on it. I always thought that was bizarre.

There has been a major increase in large landowners gating off their water in LA. So much so that is has hurt the waterfowl guides in certain areas. Areas that "everybody" used to hunt are now private, gated and no trespassing signs hung up. Same for fishing guides. Had a good friend that used to go down and hunt and fish for reds and the area he used to go to is gated off now. This gating off actually closed a through waterway to a marina there. Marina closed there doors because no one could get in/out.

Looks like couple smart asses pissed off a couple of folks you find here and are whining about it . Why start some thing if you intend not to finish it. Trying to make point can get your ass whooped if you are right . The way things are these days you need to walk off are be ready to take it to a bad ending

I've fished docks at night if the owner didn't like it I left a fish just ain't worth it
