Decent attorney should be able to help this guy. I know the internet is outraged by his shot, but I can see a case for acquittal. I firmly believe that a double gallows should be constructed on the East Lawn of The White House. Politicians who willfully and shamelessly violate their oath to uphold and defend the Constitution of the United States of America should be swiftly tried and, upon conviction, publicly hanged at sunup the day after conviction. If multiple convicts are to be hanged they can choose with whom to share the gallows or names shall be drawn from the hangman's hat to be hanged 2 at a time.

Thought you couldn't shoot a deer in the water.... My rifle was off, the deer was farther than I thought, I shot and could not beleive the bullet hit near the deer that was still in the water, the one I shot at was already on the bank. Prove which deer I was shooting at.

Seems to me this is like not shooting if you are not sure senario. Or safety comes first. He was lucky this time. If I was a judge , I might not jail him.
But he would have to get a loan before leaving court to pay all the max fines I would lay on him.
