Reckon why they dismissed the machine gun charge? And what due they consider a significant amount of Mary Jay and cocaine? And what separates an addict from casual user?

Any ways kinda seems steep for a war hero who just buried his wife and convicted of a victimless crime. That's about the same amount of time they gave bill Cosby and he drugged and raped like 20 women.

What was the search warrant for?

My guess is they dismissed the machine gun charge because it would have resulted in a lower sentence than the charge he plead guilty too.

As to the difference in an addict and a user, that is fact specific.

So, if a war hero kills someone should he get a lower sentence?

The warrant was for the machine gun. Apparently, he wasn’t keeping it a secret.

He probably advertised it for sale somewhere. Or to someone. Or maybe just bragged to the wrong person.

I could honestly care less about MJ or coke usage part. As long as someone isn’t dealing, or neglecting their kids, I could care less.

Definitely not. That's why I said a ex-pow war hero of a VICTIMLESS crime. Just seems kinda steep compared to alot of other crimes. Especially considering his age.

Federal sentencing guidelines can be a bitch.

Sorry for the redundancy, I started typing the thought, got pulled away, then finished it a few mins later. Good lesson of proof reading

Not really, you serve 85% of the sentence. For every 12 months you serve you get credit for 54 days extra.

That depends how well you're connected.
The federal prison at Maxwell AFB is basically a secure country club.

I was thinking it was 85%. But seemed like someone told me they got rid of good time. Maybe that was state time though. Or maybe just bad Intel.

If he bought the rifle in the early 80's then the fact it was full auto shouldn't matter should it? Pre Reagan executive order.

The serial number being scratched off is a crime.

Fully automatic weapons have been illegal without registration and a tax stamp since the National Firearms Act of 1938.

So what did the 1986 Reagan order change? Did it just cap the number of full auto rifles in public hands at that level?

He should have known better. The feds don't play with that type of stuff regardless what you have done for your country. He would have been better off just stealing a bunch of guns and filing off the serial numbers and selling them to the black market. You won't get more than 30 days for that. Crazy world we live in.

the definition is probably gonna change in the next few weeks, and it will be about how fast a gun can shoot, where as now it has to due with the amount of shots per finger pull of the trigger. One step closer to semi-auto's being classified as mg"s
