I drove over a creek today that I'd like to try fishing in. Its bordered by private property. If I stay in the creek its legal right?

I've read the law somewhere several years ago that basically says floating a waterway thru private property is legal as long as you don't step out of your floating apparatus and touch bottom. The centerline of the creek is the property line of each of the bordering parcels. Once you step out and touch bottom, you're trespassing. So, if you have to walk to the water you'd also be trespassing unless the property owner allowed you in there.


I firmly believe that a double gallows should be constructed on the East Lawn of The White House. Politicians who willfully and shamelessly violate their oath to uphold and defend the Constitution of the United States of America should be swiftly tried and, upon conviction, publicly hanged at sunup the day after conviction. If multiple convicts are to be hanged they can choose with whom to share the gallows or names shall be drawn from the hangman's hat to be hanged 2 at a time.

As long as he stood within the ROW he'd be legal and the landowner has no legal standing to remove him.

As long as you float you are good. We have sipsy river going through our property. We had to a problem with folks camping out on one of our green fields. Didn't care for them camping but when we had a field full of rubbers and trash we had to put a stop to it.

We wade lots of creeks and rivers just don’t get on the bank and they won’t bother you.

But once he gets on the bank to portage that canoe around a log jam he's trespassing. I guess you could take a chainsaw and cut the logjams out of the way from the boat.

your legal as long as you can float without touching bottom and the creek passes thru more than one property. you can put in on the ROW for the bridge

If the creek is "navigable" under regular water levels, then it should be considered a "navigable waterway" which as pointed out above, is legal to use. The bigger question that has not been clear in Alabama courts is whether being able to wade, touch the bottom, is legal. Howver, if you can float a canoe down it landowner can't do squat.

If it floods and the water comes over banks after heavy rains, you still can not go beyond the what is considered the stream bed.

It's perfectly legal, just don't get out of the boat. Problem I seem to have with most creeks is that they are too shallow for a kayak at times
