You gotta be kidding me. That's the ONLY two choices he had in your mind?

When he was on the ground what was the third choice?

He pulled the gun while on the ground, the guy was retreating....how about NOT shooting and killing the guy?

Thanks, glad we agree. That falls into not pulling the gun.

100% correct

It's really not hard. He had 2 choices. Pull the gun or not pull the gun. There is no third option.

So, you think every time a gun is pulled, it needs to be fired?

Cops just got a whole new direction.

I definitely agree with this. White skin is seen as weakness by most young, black males. I doubt he would have physically confronted another young, black male.

I tend to think it’s more as less tolerant with whites and looking for a reason.

When he was laying on the ground i said he had 2 choices, pull the gun or not pull the gun. Give me a third option.

I already did.

You didn't say "pull the gun or not pull the gun".

You said "2 choices here, pull the gun and shoot or don't pull the gun".

In this day and age just pointing a gun at another person is considered assault. This is why I subscribe to the idea of don’t pull a gun until it’s time to shoot it. If the gun needed to come out it needed to be fired

No it isn’t. But, keep spouting off incorrect legal information.

“Pointing a gun at a person is likely to threaten their sense of safety and can certainly give the impression of intent to harm, so people are charged with assault for it.”

https://blogs.findlaw.com/blotter/2016/01/is-it-a-crime-to-point-a-gun-at-someone.html

I’ll concede in the state of Alabama just pointing a gun would seem to be no more severe than menacing. intent to injure and an actual injury look to be the hurdles to cross for assault.

I do feel like this will eventually go to trial and a good chance he will be found guilty. Just going by the evidence seen in this thread.

Florida has mandatory minimums for crimes involving guns. The way I understand it. If you use a gun in a crime, minimum 10 years. If you fire the gun, that's minimum 20.

I think your probably gonna see more of these type incidents too. The politicians and media has race relations in a frenzy right now.

I like the stand your ground law. Like the sheriff said he should not have put his hands on the man. If he would have talked instead of pushing the old weaker man to the ground he would be alive today. Maybe the next person that thinks about putting their hands on someone that is weaker than them will think twice before doing so. You can clearly see the the aggressor was going to something else to the man while he was on the ground UNTIL he saw the weapon.

The shooter was only 47 so I don't get the old man chit. He shouldn't have been arguing with a woman with kids in the car to start with and there's no way for us to tell what he was saying or how he was saying it. If I walk out the store and someone is pointing a figure arguing with my wife we're gonna have a problem. Guy that got shot did nothing but come out and push the guy. IMO he he wasn't gonna beat the guy. If he was he'd busted him in the mouth and got on top and continued whooping his ass. If the shooter had been making threats to kill people I hope he gets what he deserves.

How do u know who the weaker person is? I was taught to never underestimate your opponent regardless of age, color and size...

Rachel Dolezal, is that you? You are just taking a wild arse guess. I don't care what the color is. If someone blindsided me onto the ground, I'm likely pulling on them. I doubt I'd pull the trigger but I don't know.

My bet is the DA will take it to a Grand Jury and get the outcome he wants.

This. Sad for all involved

Word to the not so wise jb20 and James words don’t hurt but he found out that putting your hands on somebody will get you killed.
