Yes I realize that killing the dog is the appropriate response. Anyone that knows me knows that I would not hesitate to do that in a heartbeat right in front of the owner. My wife is seven months pregnant and is high risk with the pregnancy. I do not wish to be in jail when the baby is born and that’s exactly where I will be if I do that, no question about that.

As to the quarantine, yes, but it’s UP TO THE OWNER to take the dog to the vet to be quarantined. Animal control does not pick the dog up, I was told that by the supervised at animal control. All the owner has to do is say “yes we will take the dog” and that’s the end of it. Nothing will be done.

From experience- the dog will have to be taken to the vet for observation. No ifs, ands, or buts. Get an attorney and they will go after the homeowner’s insurance. The attorney will tell you it doesn’t matter if you were an invited guest or not. I was told if you’re boiling water for spaghetti and a burglar enters your dwelling and is burned by the boiling water, you are liable. Same with the dog.

The owner should have been horrified that their dog bit your child and offered to pay for his medical treatment immediately. If they did not, then I would dang sure question whether the dog gets properly quarantined or not. But, the county health dept. should see that it happens as well as soon as they are notified.

I would talk to a lawyer my wife got bit last year but not that bad. I filed a report because negligence is hard to defeat . Sounds like in your case reports have already been filed.

I'd push this thing until I knew for a fact that the dog was quarantined for the appropriate time. I'd go as far and as high as I needed to take it. Did the dog have a history of aggressiveness? Has it bitten anyone before your son got bit? Please don't let up on the authorities until the dog has been quarantined.

As said before, if the dog has not been vaccinated for rabies, by state law he has to be quarantened at a vet's office for ten days. Not sure how a city ordinance would supersede the state law.

City laws may supersede state laws but are only when more aggressive than state laws.
At minimum will be quarantined, or have the head submitted for rabies testing.
Call Local County Health Dept. and speak with Environmental Dept.

Last thing you want to do is kill that dog. They’re supposed to be quarantined for 10 days or tested or your kid has to get shots. I don’t know what’s going on in Scotsboro but that’s the way it’s always been when I’ve had to deal with it. You don’t want that dog disappeared or dead because you need to make sure it didn’t have rabies.

As far as I know, the only way to test for rabies for sure is to put it down and send the head off (just like they would have you do with raccoon, etc.)

From what I am reading now, the current school of thought is that if a domestic dog, cat or ferret that appeared healthy at the time bites someone, it can be quarantined by the owner for 10 days and if it shows no signs of being rabid than the person does not need the anti-rabies prophylaxis. And that is not specific to any particular place in the US.
