My sis had an accident during work at one of the Big Box stores in SC. She broke a knee, wrist on one side and a hand on the other. Getting help seems to be a PITA. She's now home and can barely do basic functions, relies on others, and getting assistance with high $$$'s seems to be the norm. Any suggestions? I told her to get a lawyer, but what the heck do I know. I don't think Alex Shunnarah calls SC. Thank you.

How long ago did it happen? Keep in mind that with work comp, states have a set dollar amount that body parts are worth, and only in certain circumstances will the company go over that dollar amount. Sometimes an attorney can help move along, but a lot of times they just end up taking part of the money that the employee would normally get.

I used to be anti lawyer and suing but an employee has to look out for their own interest. A friend and coworker was of the same mindset as my self of you don’t sue your employer. The workers comp doctor they were sending him to recommended sending him to an orthopedic doc for the back injury. This doc recommended surgery but workers comp denied it and put him on more physical therapy. Luckily he applied for his disability if not he would have lost everything. They were flipping money on credit cards to survive. Workers comp is your doctor they are looking out for the interest of the insurance company only. Also my friend 10 years later is still hobbling around with a cane

No point in retaining an attorney unless the employer negligently caused the accident. If that can be proven, there could be coverage under the employer's liability portion of the policy.

Workers Compensation is a function of the state's statutory laws. They are predetermined by the state law that the accident occurred in as to what is paid for what.

The doctors that are used often do not give the highest level of care, it's a crappy situation no matter what because you are not in control of your own healthcare at the end of the day.

Some states give you the right to choose your own doctor for workers comp care. I don’t think South Carolina is one of them though.

Don’t accept their first offer, they will try to low ball her. Second do not close out meds in the case. That way if she has problems down the road she has something to fall back on

I believe you get to choose from a panel of 3 doctors or at least that’s how workers comp is handled where I work. Now you will have to ask for this. They won’t offer it. A workers comp lawyer is really the only way you will be able to deal with them if it’s gotten that bad. Yes they will take a little money in the end. 10% around these parts. There’s laws saying what they can take. I don’t know if it’s federal or state determined.
