A LEO cannot stop a vehicle leaving a bar or establishment merely because the driver left said establishment. Right? Guy walks out at 1 a.m., drives off, cop stops him a mile away to check. That's illegal. They must have legitimate probable cause to stop them.

(side note -- too much bad chit gets done when the LEO makes up something for a stop, but that's a discussion for another post)

How can a GW stop a truck coming from another state just because it's (1) A truck, (2) has mud or camo or a guy in camo, (3) has a covered camper or bed cover, (4) anything OTHER THAN a visible deer, whole, or deer parts in the bed-trailer-other that clearly would be visible?

They can't. Saying, "Oh, a truck coming from Tennessee, they might have a deer so let's check" is not probable cause. It's bullchit, nothing more than a DCNR version of Stop and Frisk, which was and is unconstitutional. It's the same chit they were doing with the roadblocks down in Barbour County a few years ago, checking drivers for licenses and any deer or wildlife "just because we can."

No one will challenge it, though, because they don't have the money, willpower or a "well, it doen't matter so let's all be good conservationists!" mentality.

If they're doing this on 65 and 231, or 72 coming from Mississippi, or any other border point, why aren't they set up and stopping vehicles on Highway 5 near Brent or US 331 or I-20 near Heflin or absolutely any other road in the state? Those trucks MIGHT have a deer in them. If these checkpoints are OK to do on 65 and 231, why aren't they doing them everywhere?

Its high time DCNR got bitch slapped in court on a variety of 2nd and 4th Amendment issues. Hopefully that will happen at some point soon. Many of their arbitrary regs are solely intended to permit lazy law enforcement at the expense of constitutional rights. Think about how they can supposedly search your person, vehicle or boat just because you are engaging in lawful hunting or fishing. No probable cause needed. That's BS and illegal. Think about WMA firearms "rules". Its BS that you can't have a rifle on public land during off seasons as long as you aren't using it to hunt. The 2nd Amendment is pretty clear on such infringements. In light of recent court rulings DCNR needs to be bent over by some federal judge for this crap. Of course, even if the behavior ends there will be no personal accountability for those responsible for decades of violations.

I can assure you that if a LEO wants to stop a vehicle, it doesn't take long to find a reason, albeit pretextual stops are not legal.

I always assumed that before hunting was a State Right and a GW has the authority to search anywhere game can be hidden, you are pretty much consenting when you bought a license. Now, with hunting being a right, I'm with Clem, if challenged, the courts would shake things up. I'm not sure how Chuck and the guys are going to get around the being a right thing.

Lord, please help us get our nation straightened out.

Okay guys I'll be the scapegoat. I'll take a blue tarp and cover something in the bed of my truck and drive across the State line while wearing an orange hat. I'll drive the speed limit and obey all traffic laws. I'll also have a couple of GoPros running. If I'm stopped by a game warden cha ching!

lol, It DOES NOT have to be deboned. It simply has to be free of spinal fliud and/or brain matter. I saw a guy de-boning one this past year in Idaho on a side road and asked "WHY?". The knucklehead spent about 5hrs processing a deer because his friend told him it had to be deboned lol.

I have brought back plenty of deer from MS and they were all either processed meat or quartered up, I have never been stopped or checked when I cross out of Meridian, MS back into Cuba, AL and that area up that way. I have seen game wardens driving down the highway, but I have never seen them pull anyone over. If I kill a buck in MS, I just start the euro mount process by skinning it out and boiling most of the meat and brain out.....If I plan to mount it, I just take it to the taxidermist.......

GWs have no more legal rights than any other law enforcement agencies.

Correct. Just get rid of brain and spinal matter and you're GTG.

Pretty sure wardens are federal aren’t they? Know a guy in MS got pulled over for excessively speeding and got a DUI from a warden..

Pretty sure a state trooper can't just come walking on your property looking for stuff, but a game warden can. Idk what any of them can and can't legally do, but isn't a game warden allowed to search and seize stuff other law enforcement can't.?

4th Amendment is the same for all LE. Game Wardens have just gotten away with abuses because they haven't been challenged in court yet (here). A few years back the courts in Tennessee put an end to their trespassing and illegal game camera monitoring of private property.
