Panting property lines has been on my list for sometime. I plan to cut a few hundred 12” 1x4s put on a good coat of paint and pre-drill for nails. I will keep a few in my buggy an put up as time allows.

Not a good color to use. That is the color often used by foresters to mark trees to cut or not cut. This might give them a defense in court.

It was 43 dollars. I had it surveyed but hunt on x and the county’s maps are off probably 25 feet. It shows me owning part of my neighbors pasture on the west side. Then it doesn’t go far enough south. That ain’t my opinion that’s after a high dollar survey

Your orange paint doesn't meet the warning requirements in the law that purple paint does. It just shows the boundary of the property. Or like Jawbone said, it may mark trees to be cut.

So about all you can do is tell them to leave, and that will be their warning that your orange paint didn't give them.

The law defines the following form of indictment for trespassing:

________________________________________________

Section 15-8-150

(98) TRESPASS AFTER WARNING.

A. B., without legal cause or good excuse, entered into the dwelling house or on the premises of C. D., after having been warned within six months preceding not to do so; or, A. B., having entered into the dwelling house or on the premises of C. D., failed or refused, without legal cause or good excuse, to immediately leave upon being ordered or requested to do so by C. D., or the person in possession, his agent or representative.

Then don't rely on a can of paint. Get with the neighbor, agree on the line location, get it surveyed and file a deed. Only way to really "nail" it down. I'm sorry, but paint ain't gonna trump what is filed in the courthouse. Dealt with this exact scenario many times. If there us nothing in writing, the judge will go by what is filed in the courthouse. Verbal agreements mean nothing when one party dies.

it is very common. Those county maps are drawn by people who don't know much about deeds and overlaid on an aerial map to best fit. There is a reason every one of them are stamped "not for conveyance, for tax purposes only." It pisses me off doing a survey on property and some dumbass neighbor disagrees with what I am doing and runs to get their survey. It is always a copy of a dang tax map. It is amazing at the number of people that think those things are actual surveys and thet they own part of their neighbors house.

I don't understand the" file a deed " part. Would you not record the survey with some sort of agreement document attached?

The land was surveyed deed is filed every thing is settled and legal. But purple paint is part of the law I don’t no why but it is. Even if you pay 4000 dollars for a survey and the corners are marked it don’t keep some jack leg from trying to hunt on it. Some of them thank since pawpaw cousin told them the line was a certain place that is where it is. I lease all the land above and around the moody brick 1000 acres almost. The lady that I deal with passed 3 years ago and her son is an extremely nice guy. But he came up last year and said can you show me where my lines are. They logged some of it 20 years ago and they wanted to be shown the corners. According to the tax maps it gets way off in one place. I declined getting involved in a timber dispute

You can't prosecute on the first offense. They are warned by the leo's. THEN they are charged and fined on the second offense.

I honestly don’t think you are right about not prosecuting on the first offense part . But their are some on here that could clarify that.

Golden Eagle I think you misunderstood my post I hope I clarified that. I lease a couple of places but this is land I bought and paid for and got deeds filed on I am talking about. Loggers cut what joins my back line and we walked it together. iWork for duck farms that people have bought that have money 90% of what most of us only dream of. Had a guy drive up on a side beside right where I am sitting about a month ago and wanted to know whose land this is. He owned land 400 yards from here and crossed another farm to get here

I would not prosecute somebody like that it was an honest mistake on their part and now I work for him so it all worked out for both of us. I have been hunting in this bottom for nearly 60 years daddy would carry me on his back across the slews because he loved to squirrel hunt and there wasn’t any beavers back then never saw a deer till I was probably 12 . Never saw a turkey till the late 70S But we killed the heck out of squirrels , Swamp rabbits and Ducks. My geat grandpaw owned 700 acres Moodys owned 1000 acres north of us give or take a little. Budlongs have 960 to the south. Some of the heirs as they got older did not have any use for the land. I bout cried in the early nineties when 2 strips about 135 feet long each and a mile deep sold for 600 dollars an acre. It might as well been 6000 because I was trying to raise a family that needed stuff and it was out of the question. In about 98 - a 128 acres with a decent old farm house came up for sale man did I want it but my job was very unstable and my wife didn’t work and we had 2 girls in school . It sold and when Ainsworth’s ended up with it a few years later it listed for 675,000 3 years ago and it sold I don’t know for how much but it was down to 113 acres at the time. The people that bought it are out of Franklin Tennessee and they are fantastic to me. Got a cabbed 5075e and a 308 cat that they have never been on and they said get us ducks do whatever you need to. I bought 65 on the other side of me that if I ever can afford to fix it up the way I want to will be a prime place. I don’t even know if this post makes since. I would type a sentence and then scan around for for a big nanner head it’s beautiful here I like this kicked back in a chair hunting with your phone in you ur lap. It’s more about the grand kids and friends killing deer to me now

My takeaways from this thread... 1) Obviously the laws need to be changed... people know dam well they are trespassing nobody should be accepting the line.... "oh, I thought since it wasn't painted purple it was open to the public"... that's just ignorant and ignorant deserves a ticket just the same IMO.

2) got some piddlers on here.

As long as something is put in writing and filed. Terminology makes little difference as long as it is just not a verbal agreement. I see those go sideways all the time once one party die

Funny story, I use to think purple paint was state land so I was hunting on all of it that surrounds bankhead. Never had any problem. Which reminds me.... My grandpaw didn't care who owned what. He was a number one piddler. He set plenty of bad examples on me but damn, he was hilarious and we had the times of our lives.

He was old school and was friends with the Landowners but they had the lands leased out to clubs. We shot tons of deer in summertime..at night, whenever we wanted to. This was in the 80s. I saw that man tear down every tree stand in the woods too. Poppaw was crazy 🤣. He was the definition of an outlaw. Born and raised in the holler, never owned a driver's license.

Yep, didn't catch that part. Just wanted to make sure it wasn't a verbal deal. Those are great as long as both parties are alive. When they aren't, it becomes a he said she said and a HUGE mess. I have been in the middle of that my fair share of times and it is not fun!!

Recently prosecuted two gals who drove a ranger all over our place trying to get onto a public road from another property. Drove a new Northstar Ranger through some trees to go around a gate to get out. They only paid $50 fine but cost will be around $300 probably. First offense.


"Cull" is just another four letter word...
