Cook doesn't sing with the band very often now, he isn't physically able. He has had Parkinson's disease for several years. I understand the weed helps offset some of the symptoms & enables a better quality of live.

I just don't see how that is reasonable until there is a method developed to determine how under the influence one is while driving like there is for alcohol.

Weed actually makes you a better driver. You driver slower. The reason you don't really hear about weed and wrecks being an issue. The number of folks driving around Montgomery and Bham smoking backwoods on any given Friday or Saturday night has too be high... they seem to never wreck



That is bulldoodoo. I've smoked more weed back in the day than you can even imagine. Weed definitely affects your motor function and your decision making process.

I agree with TesasHuntress... We need to figure out a standard for driving under the influence.

2nd Degree. No big deal. He can make this go away with a little diversion program and/or community service with the right donations and i'm not necessarily talking about payoffs to judges or DAs. Legit community service, donations and a day or two in a drug awareness program and he'll get it dropped or he can just pay a fine. The problem with just paying the fine though is the next one becomes a felony in Alabama if he already has one on his record. Smart move is to keep it off his record with the diversion program.

It ain’t gonna go away. It’ll still show up that he went to diversion and got it dismissed. It may keep him from serving time for it, but it’ll still show up as an arrest on public records. And the next time he gets pulled over, I’m sure the officer will see he was arrested for it.

But he went to diversion, so that should remove any suspicion from his mind.

An arrest and a conviction are two different things. If he ever fills out a job application for instance and it says have you ever been arrested he would have to answer yes, but then it will ask for the disposition and he would answer "Dismissed". Same thing with another weed arrest. If he is convicted of this one the next one is 1st Degree and is a felony. The only other way it is a felony is if it is such an amount that it is considered trafficking. The successful completion of a diversion program means there is no conviction. The key words are convicted of a previous weed arrest, not having been arrested before. I'm sure other than some embarrassment, this is no big deal to him. Just like Willie Nelson, I imagine no one is worried about it. LE has enough to worry about with Fentanyl and Meth in that area to get too bent out of shape over this.

Don't know the circumstances so I won't question the use of discretion yet. Believe me, sometimes people put an officer in a situation they don't want to do it but aren't really given a choice with all the liability they face these days.
