Is this a civil case? Sounds like you are not going up against a public prosecutor. Rape 1st degree, class A felony, criminal case.

Pretty specific timeline for the beer drinking. Odd that one can remember when each beer as consumed.
The left lane is for the the purpose of moving the flow of traffic forward regardless of the speed limit. If your impeding the flow of traffic get your ass in the right lane. It's really that simple...

Neither have green cards or are Americans, so why aren't they already being deported? Who gives a chit if she was raped? They're not citizens so why should they have any kind of protections from our legal system? Non-citizens get due process?
Isn't that what we're supposed to do with "them" when they're discovered? Call ICE and hold them and send them back?
They're here illegally. Send 'em back. Right?

I would have a hard time sending a guy to jail for life based upon that scenario. If she drank 4 beers over 3 hours basically, she would not be drunk still at 1am.
I think the appropriate consequence is deport both of them. If she had never had a beer, 4 beers would sure enough get her plastered. Maybe in the first couple hours they were consumed, but not six hours after the first one went down the throat. If the guy has any credibility as a witness, I think he has to tell his story on the stand. I know there’s risks there, but if he has credibility and nothing comes out on cross as a “gotcha” then I’m voting to acquit him. I can’t exclude all reasonable doubt that there was a rape in that situation.
