I don't see how you could give a field sobriety test on a boat. The stand on one leg and walk a straight-line test would bust everybody's azz. We'd bring em back to the station, and do it on asphalt. There is a 10-15 minute rule anyway. There was back then anyway.
Life is a journey. Make sure and bring plenty of Beer.
My luck has been so bad lately, it could be raining pussies and I'd catch one with a dick broke off in it.

If you are on a state owned/ran lake, it's illegal to have alcohol on your boat. Aren't they all?
There is 2 different high fence. 1 small and one big! Mine was free range in the big pen and was not a breeder buck. Why does it have to be twisted around??

Don’t get caught on Smith lake. We hired a guide one time for a Striper trip. We had beer. Only until we were about underway did the guide tell us we were in a dry county. He was fine with it as long as we understood that if we got stopped it was all on us and not him. We didn't have any issues and it was a great night of fishing.
Lord, please help us get our nation straightened out.

Crazy to think there are actually still dry counties. What's even crazier, is google it and look at the map of dry counties left in the country.

We were kayaking terrapin creek last summer and 3 of us in my group got tickets for possession of alcohol in a dry county. It cost us $500 each. They stopped and searched everyone that had a cooler visible. They had a line of us on the bank taking our mug shots and writing tickets. Good thing they were in trucks because that was the only way they were hauling all the beer they confiscated. $500? For having a cooler? What a racket. Makes me wanna go run for mayor in some dry city with a boat launch.

To answer the original question. Yes, if you are boating on Smith Lake and have possession of alcohol you can be charged up to $100 per beer. My friends across the lake and i do mean straight across the lake (150 yrds max) loaded up their pontoon to come over and visit with two un opened cases of beer and was boarded by the water patrol as they left their dock. The driver claimed the beer and was awarded a $4800 citation (Probably wouldnt have been as bad if he hadnt been a little confrontational) but yes it can get real expensive on Smith. Was this due to being in a dry county?

Yes, you can have drinks at a few venues on the lake due to a permit called the tri county alliance but once you enter the roadway or water it is dry county law regulations

Like the response said, being belligerent certainly didn't help but $4800 is way excessive, and probably a Constitutional infringement for just having some beer so I'm thinking that the belligerency must have led to some other charges. Disorderly Conduct plus the beer certainly comes to mind that would lead to such an excessive fine. Felons generally don't get fines like that.

This is the only thing I can find with a quick search online. I even went to the ALEA website and it only addresses "Boating Under the Influence" of alcohol or drugs and that is the same as on land in a vehicle.
It is legal for people over the age of 21 to possess an open container of alcohol on a boat. Boating laws are not the same as the laws that govern alcohol use in land-based vehicles. The Alabama “open container law” applies only to public roads and rights-of-way, Brooks said.Oct 3, 2010 This. Jackson County is still dry. There’s a bit of Lake Guntersville that lies within the Scottsboro City Limits, which is wet. If you’re gonna have open beer on the boat up here, you gotta stay inside the city limits. Outside of that, the open container in a dry county will get you a ticket.
