If the case is active with the court system, then the child should have a guardian ad litem. That's where I would start. If there is not an active case and you have concern for the child's well being and if the child is in the legal custody of the person whom you have concerns, you may also file a dependent petition yourself. I work within the court system, so please do not view this as legal advice, but options you may have.

Do not blame the DHR workers. After some children were hurt in foster care years ago and DHR was sued, they entered into a Consent Decree, called the Hatch Decree, that mandates that they do everything they can possibly do to return children to their parent (s). The workers hands are severely bound by this decision. I guess it could be overturned when enough children are placed back in the hands of irresponsible parents and are killed. Unfortunately, I don't know who would have standing to sue in order overturn Hatch. Like Justice said, each child will have a court appointed attorney (Guardian Ad Litem) to represent their interests, but I don't think that would carry over post mortem.


Lord, please help us get our nation straightened out.

If the parent did not Have a prescription that would be a very suprising decision. That wouldn’t happen in Bibb County.

June 2018 I was 6 months from retirement and looking at building a place to retire to on the lake. The next day it all changed with this child coming into our care. I'd not trade her for anything but the stress over the last 18 months has taken it's toll on us. This isn't how I saw my retirement from firefighting. I'm willing to sacrifice for this child but damnit man we need someone in our corner.

There are federal funds at stake so local DHR and state DHR do most everything they can toward reunification. Yes, more funds for closed cases that return children to their birth parents...Often at horrible costs. It's a perverse system and everyone in it knows how it works, including the case workers and supervisors and directors and DHR attorneys and judges. I have first hand experience and knowledge.

Call Buddy Hooper at the Alabama Foster and Adoptive Parents Association. He is your best advocate.

That blows my mind. How is that even possible? Call Steve Marshall's office. I'd be very, very surprised if he wasn't able to help.

The decisions DHR makes absolutely blows my mind. I know a family that fosters children that I wouldn’t let be responsible for watering the plants, but DHR continually puts kids with them. My two cousins (they are sisters) used to both work for DHR and they could’t grab their own a$$e$ With both hands.
