If your kid got rear-ended and the other driver ran off but you got tag mumber, could you file a lawsuit (small claims) against a "john doe" then use a subpoena to get the owner information from DMV.

Don't take this as the gospel, but I don't believe the driver is insured, the vehicle is what is insured. If you know what vehicle hit your son, let your insurance deal with the other vehicles insurance, if any. Let the police handle the hit and run. But, you have to know who owns it to find out about insurance. You can’t just magically conjure up an insurance policy.

Well that sucks. If anybody in Birmingham area sees a white Toyota Sequoia with alabama tag 2813A000 and a busted out headlight, throat punch 'em for me. File a report, they will find out who it is and then you could file a claim with their insurance. That isn’t that uncommon.

File a claim and send in a copy of the report. The insurance company will come up with the policy holder some how. that's their business. Either they can pay or the other company. Believe me, they want the other company to pay. That's what we did with my wife was hit and we got the tag number.

If they act like they know nothing about the damage, just turn it over to your insurance company. That is why you pay them.
Now if someone is injured in a hit and run that becomes a whole new ball game. It then becomes a felony and should get more attention from the police.

People that hit and run should automatically be shot between the eyes. Even if nobody was injured. Case closed Or driving without insurance.

I don't think that just a tag number will do you much good unless you have a witness or a picture. Just turn it over to the insurance company and let them deal with it. The driver of the car hit is the witness. Do you have any idea how many crimes have no witness but the victim?
