How can an ex keep you from getting your kid when it’s your time to have him? Is there a chance a judge would lock her up for breaking an order?

I have read alot of divorce decrees with what I do for a living, but dispensing legal advice isn't in my purview. That said, when it comes to my kid I would be talking to an attorney, not asking this bunch of good ol boys.

What is her excuse? All you can due is threaten her with legal action. My son's ex did this to him. He showed up and she called the cops. Cops said it was a civil matter. All he could do was request a welfare check and the police could enter her house to check on the welfare of the daughter.

I've been called to a lot, and I mean a lot of these issues over the years and the answer is this. Does the order specifically state when you get the kids, as in the exact dates? If not then LE isn't going to get involved. You are going to have to get your lawyer to let the judge know she isn't living up to the order. Usually, your lawyer will call her lawyer and they work it out. If not your lawyer will get a hearing before the judge and he will usually issue a more specific order if they think it is warranted. If, on the chance that the judge become angry that she violated the order, he/she might hold her in contempt and give a small fine and threat of jail. If the judge is really angry at her he might even lock her up for a few hours, but that is the extreme.

Bottom line, to get anything done, you are going to have to talk with your lawyer.

I’m not divorced but many of my fellow soldiers are and from I can tell you have no rights and she can basically do whatever she wants. That may not be the right answer but that’s what it looks like from the outside looking in.

. I guess you only have rights when that retirement check stops coming every month. That’s when a judge usually wants to throw you under the jail house

No it’s a power trip with her. I seen it with her ex husband and her when we were together. She thought she got to decide when her ex got her son regardless what the papers said. Tho she was quick to get mad when he stopped paying CS

Right, not only for the custody matter but to head of the eminent DHR complaint. Maybe even an abuse complaint to LE. I only dealt with this type stuff a thousand times in my career. People trying to use DHR and LE to side with them in custody matters. Sorry it is going to cost you money, but call your lawyer now.

My brother went through this and he had the police make a report everytime, then took her to court and the judge told her if it happened again she wouldn't be going home. It stopped after that.
He filed the paper work himself and didn't hire a lawyer

3 lessons that I have learned over the years, (this all coming from someone that's never been divorced and has no kids), but has been through a lot of them with friends and family.

1. Divorce is the worst financial decision that a man will ever make.

2. What ever makes perfect common sense is 180 degrees opposite by law.

3. Whom ever decides to represent himself in a court of law, has an idiot for an attorney and will lose.
