Long story short, my credit card has a credit tracker on it and I got an email the other day that there was an alert on my credit. I look and low and behold it says my mortgage is 120 days late and foreclosure has been initiated. I google my name and address and find a legal ad in our newspaper that says our house is going to be auctioned off. I freak out but can do nothing cause I'm at work and it's the weekend. Wells Fargo is closed Monday for the holiday so wife can't call till Tuesday. In the mean time she swears we ain't behind ain't got no calls or letters or anything. Well she calls today and they tell her everything is fine we ain't behind and we are good. Tell her we have to write all the credit bureaus and and Wells Fargo and tell them this is a mistake and take it off our credit report. They told her it was a clerical error and it happens all the time. Well nearly having a nervous breakdown and my belly tore up all weekend don't happen all the time to me so it's a pretty big deal. Is there anything I should do? Should I get an attorney? Is this gonna come back and bite me in the butt? Do I need to call anybody in particular besides the bank and ask about this. Another thing, we mysteriously can't log on to their website to check anything. They just tell us to keep trying. I'm about to go crazy over this. Any ideas?

That sucks. I feel if they screwed it up, they should be writting the freakin letters not you ! But who am I ???

It seems to me that whoever handles your mortgage and said you were not behind in payments should be the one to write an official letter for you to submit to the credit bureaus. Even if they have to write the letter to you and your wife for you to fax to the bureaus, it seems like you would need more proof than the just taking your word for it that it was a clerical error on the mortgage holder's part.

IMO, that is something that should not "happen all the time" either.

Wells fargo is the worst bank to deal with as far as my experiences go. A couple of years ago me and my wife went to get a car and one of the places contacked for a loan was wells fargo they come back and say I defaulted on a lincoln navigator 8 years previous and I had never even got a loan for a car before. Turns out someone used my ss number with a different name to get a loan it doesnt show up on my credit anywhere but them. So this should be an easy fox right show ss card and drivers license and clear up. no I had to make a police report fill which I did and then they sent me this huge packet to fill out on reporting fraud which i never did and decided i didnt need to because I had made up my mind i didnt want to deal woth the bunch of asshats at wells fargo ever again.

I spotted your problem right away, Wells Fargo. All personal banking should be done with a credit union in my opinion. I can't see any reason anyone would do any business with Wells Fargo or Regions.

#1 thing that they wrongfully told you is for you to write the letters. The credit repotting agencies have to have a letter from whomever generates the negative report. In your case it will have to be on Wells Fargo letterhead. A simple letter from you disputing what WF reported won't be considered anything more than junk mail.

Credit union is the way to go. Had a bank do something similar. They got to fix that screw up. But I also swapped banks.

If I was you, I would contact the attorney that is listed on the foreclosure notice as well. I would not trust Wells Fargo to get them to stop the sale. His name should be listed on the notice in the paper.

Also, I would get a written confirmation from the bank and the attorney to be sent to the credit bureaus.

2 words will answer this problem --- WELLS FARGO. They suck, that is all.

If it was falsely reported by w-f, I'd contact a lawyer ASAP and threaten to sue them if they don't fix it right now. Mistake or not, this could haunt you for a long long time. It's unfortunate and not your fault but you need to get this fixed right now

I know a guy that went to work for WF right out of college. He hated working there because he felt like he was screwing people over. He left as soon as he could find something else.

This. 1st Alabama bank made an error on my account many years ago that caused an overdraft/returned check. When the error was discovered, they wrote several letters for me.

Wells Fargo is awful. Had a car loan several years ago with them. Always paid a little more than what was due so I could stay ahead. Had a rough month so let the payment slide. I was a payment and a half ahead according to my account. Come to find out I get a late payment notice. Seems someone else made a payment using my account number so I wasn't ahead as far as I thought. They took that credit away and never notified me. Had to fight with them bastages to get it fixed. Only deal with the credit union now.

If you write a simple letter to the credit bureau disputing the report, they have a set number of days (I think it's 30) to prove that any debt they show is factually yours. If they can't do that, they will remove it.

I would take the advice of Doekiller. seems like you did nothing wrong but you're probably going to have to be proactive in getting this cleared up.

If you don't make sure the attorney stops the sale, then you are going to have a lot more work to get it straitened out. After the sale, a foreclosure deed is going to be filed and that will really screw up your world.

Hmm, I'm thinking it might be a good time to lawyer up. If it goes to sale I gotta think you have a decent chance of getting a substantial settlement.
