Here's the deal with PVP wheat. A farmer can save combined seed to replant on his own farm. Just can't resale to the public. I handle this daily.

Joe, if planting feed wheat was illegal, half the state would be in trouble. Your seed guy is referring to this....but he has his crops mixed up.

Isn't that what the seed store guy was telling him? Joe wasn't combining wheat.

I plant feed wheat some years too so I don't really care one way or the other, but I don't think the seed store guy was technically wrong depending on the variety. Maybe he was a little dramatic and over ambitious though.

There are a lot of patented plants, not just GMO's. Isons' muscadines are patented for example.

99% of the people in the state brake the law every day when they they get behind the wheel and speed. The only discussion we had was about wheat and was about feed vs. seed wheat, not if legal to plant any type of wheat at home. The little I have read says you can plant yourself, but have to pay fees, etc. I guess there is a big difference between things being illegal vs. anyone actually inforcing it.

Funny thing is, I had planned on planting cereal rye as a cover for a mix of other things for the fall. I had only asked the guy because I saw the post the other day about feed wheat and I happened to be in a store over the weekend. Was just trying to learn price differences, etc.

I know there are a whole lot of patented wheat varieties. I've heard the bit about it being illegal to plant feed wheat. I've planted it in the past. I have heard the line about it being illegal many times at our local co-op. They are serious enough about it that they don't even sell feed wheat anymore. They haven't sold any in years. They keep a real cheap seed variety instead, which is actually better because it doesn't have wild mustard seed in it.

Yes, it was a treehugger page, but they were referencing the case (link 2) discussed on Wikipedia.

Seems patent stuff can be silly. I contacted Eagle Seed a while back asking if I could buy a handful of soybeans to plant a small test plot in the backyard. They wrote back saying they can only sell 50 pound bags because of the patent.

Yes, he was saying he tends to let his feed wheat supply run dry about the time folks would be buying it for planting.
