Tennessee Supreme Court ruled in favor of the landowner. Curious how this will go.

I hope he wins, and he may in state court. Open fields doctrine needs to be abolished for game enforcement. They have continually proven to abuse it, its dangerous for land owners and the wardens, and no pine goat is worth our constitutional rights regardless of what 9 dudes in black dresses said in 1924.

In fact, I'd be for putting game enforcement under the local sheriff's office. At least they have to get elected every four years and have some direct voter accountability.

We should all be contacting our representatives and demanding a change to Title 9 to ban DCNR from entering private property without a warrant or invitation.

For interest's sake, what's the rule of law in Alabama?

I was taught the open fields doctrine in an Alabama police academy... A recent thread renewed my memory of that.

That needs to be struck down too. So if you're out camping or hiking (even on private property) they can search and/or disarm you and inspect your property without probably cause, potentially even if you aren't hunting. All this constitutional abuse is justified to protect the pine goats.

I hope he wins. If they would put some teeth in trespassing laws, that would help too.
