I didn’t even think about them being stolen. I’ll check with the gw and sheriff to see if any have been reported. Good move. Keep in mind that there are crimes in Alabama for Possession of Lost Property and for Receiving Stolen Property. On the Receiving charge not knowing it is stolen is not a defense by statute but often it is considered by LE and the prosecution. If they poacher is reading this on Aldeer he can drop a dime on you with the po po. He's Pizzed he left these great binos he stole from someone and calls the cops and tells them who you are and who the stolen binos belong to.

If he takes them to law enforcement, reports the situation, can they check fingerprints? Will they confiscate them? Fingerprints? What’s that? I have NEVER had a case where prints were taken from anything. That’s stuff you see on T.V. Here in the real world, in rural Alabama, I’m not sure that the officers are trained to do so or even have the equipment to do it.

That's how I got a car thief locked up. Repeat offender. But..I had to call in a favor with law enforcement to make it happen. They wouldn't have done it otherwise.

Here in the real world, in rural Alabama, I’m not sure that the officers are trained to do so or even have the equipment to do it. Dept of Forensic Sciences does not want latent prints sent in unless it is a Class A felony or above because of the backlog. They even send out letters instructing as much. LEO takes prints on this and sends it in and they go in a great big pile to never be looked at again. You have to do a risk/reward analysis. Call LE and they might confiscate them. Don't call them and keep them and risk a felony arrest. BTW, I think letting a GW know about the poaching would be the least likely to have them confiscated and locked away in an evidence locker and still covering your butt.
Lord, please help us get our nation straightened out.

So if I'm on my property and walk up on a pair of binoculars, I'm gonna be arrested if they were stolen? How the hell was i to know that, or even how they got there? They're are mine now.

So if I'm on my property and walk up on a pair of binoculars, I'm gonna be arrested if they were stolen? How the hell was i to know that, or even how they got there? They're are mine now. Perzactly. ^^ I thought part of that statute was about RECEIVING or PURCHASING stolen property that a person either knew it was stolen or a reasonable person should have known it was stolen. I never knew it included finding personal property (lost) on your owned real property. Lord help us who buy and renovate houses full of stuff previous owners left...if that's true.

There is a criminal statute for theft of LOST property. I represented a girl that “found” a diamond bracelet. She “found” the bracelet in a cup holder in a chair beside a pool. The owner unknowingly left it there. My client didn’t report it to authorities or inquire if anyone had lost said bracelet. She was arrested after someone saw where she posted it on an online site for sale.

Nope, if it is stolen then the legal presumption is that the possessor knew they were stolen unless the law has changed since I retired. Besides this is covered anyways under the Theft of Lost Property laws.
