Sounds like bs. They have no way of proving who was driving. When this crap is written the hope is the $$$ will start flowing in because no one will call them on it. Send them a copy of their “ticket” along with a registered letter saying the vehicle was on loan to a family member and you have no idea who was driving at the time, but it wasn’t you. Title 32, Powers of Local AuthoritiesThey don't have to prove who was driving. Since it is a Civil Violation all they have to show is who owns the car. The car is being fined, not a person. Each municipality that has cameras for this has received permission from the State Legislature that allows them to do this which is an end run around Alabama's Criminal Procedures. I hate this and I really hate that most of the fine money collected goes to the private company that owns, installed, and maintains the cameras. That violates everything I believe in for LE ethics. People learn where these cameras are and avoid running the lights there. This cuts in to the profits and we all know that when money is involved, eventually things will be fugded or shortcuts taken. That is simple human nature. Legally, this cannot affect your DL or insurance. The only way you can go to jail is if you are subpoenaed and ignore the subpoena. Then the judge can charge you with Contempt of Court. In reality though this will just increase your fine. They don't lock people up for such as this anymore. All the private company can do is hound you and threaten to have it sent to a collection agency and affect your credit score but I've never heard of them going this far. They may have but I've never heard of it before. My belief is that they know this is unethical and are afraid if they push collecting too hard someone will take it all the way up the judicial ladder and they will all get thrown out by a court that doesn't like the way cities are trying to avert our Criminal Code and the company and cities will be on the hook for paying people back. That is just my opinion from having watched cities implement them. You can fight it in court, but because it is Civil you will lose. It is a bunch of crap we allowed our legislature to burden us with. If you have any more questions about them from the LE perspective, let me know.
