That's not at all what the law you quoted says.

Hope he wins in his lawsuit, those cops were being dicks. The man was freaking watering plants for his neighbor and once he told them that, they should have said good day and left. Law enforcement these days is really in shambles. They go after the simple little crimes that aren't even crimes and allow the serious criminals to just go unchecked. It's really a shame.

These days, I wouldn't have a law enforcement job. Let's say they walked up, he told them he was watering flowers, they left, he burglarized the place? They didn't just happen by, they were called for suspicious person. Damned if you do, Damned if you don't.

Valid points & I agree, though as a reasonable person I have to believe if Pastor had given his name from the jump it might have gone smoother & could have prevented an arrest or further drama. I don't think it unreasonable to cough up your name.

He gave his name. Said he lived across the street.

Well, he said "Pastor" and I agree that's not enough. Pastor Joe Smith might have been better.

But they wanted physical ID and he didn't have it, which we're not required to have on our person 24/7 here in the United States. Even if he had told him his full birth name, DOB, address and blood type, they wouldn't have let it go and still would've cuffed him because he was black, not showing ID and not doing what they wanted.

He was in a no-win situation no matter what.

The officers were told a call came in about a suspicious person. The guy on the property said he didn’t live there. He may have had permission to be there, but at that point, his suspected crime would be trespassing because someone reported it. That would give the police valid grounds to ask for ID. I am not a lawyer and didn’t even stay at a Holdiay Inn Express last night, but that’s how I saw it. I’ve seen plenty of vids where the law enforcement officers were out of line, but this didn’t seem to be the case here.

Problem is everybody is an adversary on both both sides. If you don't immediately comply with the cops your an adversary. If the cops are questioning you and you have a reason to be there then you are an adversary.
Why can't we all just get along?

If he had just been the least bit polite and put the hose down, he probably wouldn't have ben arrested. Instead, he shows an attitude and it resulted a ride downtown. Could have been easily prevented, I thought the police officers handled it well.

A person commits the crime of “criminal trespass in the third degree when he knowingly enters or remains unlawfully in or upon premises.”

I am not a lawyer, but if the mans neighbor asked him to water his flowers, it is on the LEO's to prove he is there unlawfully. Suspicion isn't a crime. There has to be a suspicion a crime has been committed or is about to be. What's the crime? Its not trespassing. Waterfing flowers? being on the property and not being the owner? A person has a supreme court affirmed right to challenge LE, and use less than proper english while doing it. They may also criticize them.

I also think in this case it escalated when the supervisor showed up. That is what I remember reading.

I probably would have had an attitude too if they approached me like that when I was just doing my neighbor a favor. But we also all know, they never would have approached me that way b/c I'm white. Really I never would have gotten called on. That neighbor only called b/c he was black too, no doubt about it.

You know the simple solution to that. Walk over and introduce yourself. Say hi, I live right there, and this is my neighbor and I know they are out of town. Are you a friend of theirs? Boom!

I live in a subdivision, and there are people that live on my street that I have no idea who they are. And I have been there 7 years.
