The consensus seems to be that she lied and claimed to be the driver to cover for her impaired husband. I’m no expert, but I would certainly think False Reporting would be a more appropriate charge but the next boating accident I investigate will be my first. I’ve certainly dealt with this in vehicle crashes and the DA always wanted to go with False Reporting so I’m still curious about all of it.


I would guess it's another chess match. The DA knows the man was driving. Maybe can't prove it. Maybe can. But when the DA starts plea negotiations with the man, the man knowing his wife is facing jail time for what he did, will be more agreeable to the DAs offers. If the man takes responsibility, they will reduce the wives charges to false reporting. Just my thoughts.


That is a plausible theory, but not a strategy I agree with particularly. I never was a big fan of the "OK, tell me whose dope this is or everyone in the car goes to jail". FWIW, our DA didn't like this either.
