He has admitted that he knew about the 2009 issue and he and his wife counseled them then. The issue isn’t that he knew as much as it is that he lied about knowing. The university knew about this, their attorney knew about it. Domestic violence is actually rarely charged. As a public school employee, the Title IX issues have a different standard of proof than a criminal charge.
