Not an attorney, but can you just go pick it up and resale it? If not you will occur some fees that will cost you money in the end if he don't pay up. You may not get the trap to re-sale or the money either if he files for bankruptcy or just doesn't pay his bills. Not sure which route, but find a different form of payment in future. At least get half before delivery maybe. Try moving to the new online processing system. You out 3%, but instantly solves that problem. A few people will write you a check knowing it will not cash. It is used now. Won't get anywhere near the new price.

Been in business for 5+ years now and I have only had one payment problem, a client wrote me a bad check. Got that one replaced easy with a phone call. I guess it was simply a matter of time before I ran into a real problem.
Had a customer call and order a Jager Pro trap. He wanted it delivered and setup in Choctaw County. I did so on May 26. He said he would mail me the check on May 29 when he gets back in his office. He calls me a few days later with some personal tax problem issue and says he needs for me to come get the trap.
How should I handle this problem?
Go get the trap, or you're going to wind up out the money and out the trap. You're going to have customers that don't pay. No way around it really, just try to minimize it. Only way to eliminate it is to have everyone prepay 100% prior to doing the work and most people won't do business that way. We run about 2.5% "bad debt" and every time I post something about that on here, people respond that our numbers are remarkably low. On big jobs with unknown customers, we do require 50% down payment. That weeds out a lot of bad debt problems before they make it to the point you're at.
If my people, who are called by my name, will humble themselves and pray and seek my face and turn from their wicked ways, then will I hear from heaven and will forgive their sin and will heal their land. 2 Chronicles 7:14

Maybe you could setup a monthly payment option for him. Youve already stated you don't want the trap back and he obviously has a hog problem. Polish up your sales pitch and let him know it's in his best interest to settle or else. If no response then send a letter from your lawyer outlining your expectations. If still no reaction then proceed with lawsuit or WHASB.

I would go get the trap and thank the man for calling and letting me know there was a problem. Most deadbeats would just hang you out and you would have lost the trap. If the guy get his money straight you still may be able to do business with him. x 2 Lots would just not pay and dodge any communication from you. Perhaps you and he could work out an installment payment plan in lieu of having to go pick it up.

My recommendation would be this:
Step one. Go get the trap. Add whatever labor costs you incur to the total owed.
Step two. Sell the trap again. Reduce his bill by however much you are able to recover in the resale (you said that it is now "used" and won't sell for as much. He owes you that depreciation.)
Step three. Listen to Lonster and determine the collect-ability of the debt. Self employed? No suit and offer low low monthly payments. Have a job he isn't likely to quit? Go for suit & garnishment.
Of course, all of this really depends on what your contract/agreement specifies...

You could just relocate all of the hogs you catch other places to his land. Maybe he'll pay up. Lol. WHASB= Whip His Ass SeaBass
