If this was done, people would fight the charges and many game laws/ enforcement practices might not survive judicial scrutiny. For instance, a person is walking 50 yards from a feeder on their own property with a rifle in May. Why is he not hunting out of season/over bait, if someone doing the same thing in January could be considered hunting over bait?

The statute makes it illegal to take or attempt to take a game animal with the aid of bait. I honestly think that “attempting to take” would be subject to challenge as unconstitutionally vague, if the argument was framed against 2d Am. rights. The fines are simply too low for anyone to incur the legal fees to challenge.

Extremely excessive, especially for private land. I've been stopped twice at Cahaba this year. I'm actually glad they are out there because it keeps people honest. Wish they were here yesterday. Had a guy walking through the spot I was in at 75 yards with a bolt gun on a primitive weapon day. Hate to hear that a hunt you were looking forward to got ruined.

A few years ago myself and a bunch of others folks got tickets for hunting over bait at a dove hunt. 30+ people on the hunt. I didn’t see any corn but apparently the landowner had put cracked corn out the weekend before hunt and then disced it under but it was within the 10 day rule.
Anyway, when the GW approached me he checked my gun and license and then told me I was under arrest for hunting with the aid of bait. He then asked me if I had a cell phone and told me to give it to him. I complied and then he told me if I started hollering game warden he was going to take us all to jail.
I didn’t think much at the time about him asking for my phone but looking back on it I realize he had no grounds to take my phone and I should have told him NO.

Thanks for the explanation. I would think the GW was very much out of line even though it was leased land.

I probably wouldn't be quite as defensive if it didn't happen on land I owned, but I don't think I could give up my phone in any situation unless I was arrested. I hope I am never put in a situation like that.

Me and BC had a similar situation last turkey season with one of the wardens mentioned here.

Came in when the turkeys were gobbling, asked me and my son where the bait was and wanted to walk the property. We walked around the entire property(small) watching him pick up every small seed or small thing in a field thinking it was bait. After he was satisfied he wanted to know where my buddy was. I told him I dont know to go find him, once he located BC he made him do exactly the same thing and walk around for a hour looking at anything small he could call bait.

N2 and I got checked last spring while turkey hunting by Aurora. First words out of that clowns mouth to me was “Let’s cut the chit boy, where’s the bait”? Then he made Brandon and I walk him around everywhere we had been and all the while he was picking up little sprouts and flowers off of the bushes trying to find some “bait”. Then he capped it off by accusing me of being on the neighbors Property because he had found some old boot prints. Our neighbors land is a giant cotton field. Like I’m going to go sit on a damn cotton field when all the gobbling turkeys were on the lot we had leased.
