CAB can make a regulation but cannot make a law. Alabama baiting is under the law part and should a not be able to be superceded by a CAB regulation...but who knows??? That's what I thought too.

I guess I'm confused about the law/regulation part. If it is a fineable offense to not have the useless game check harvest record that the CAB came up with I would have thought that it would be against the law, and that if they proposed a "legal" bait provision then that would be a "law" regulation? What's the difference? Let me channel my inner 49er here.... CAB can't make laws, that's congress's job. You know, the people we actually elect. CAB can only make rules. CAB serves as an advisory board, and I think congress could overturn these "rules" but almost never do. It's basically representation without accountability. Think about it, what if Vladimir Putin or Kim Jong Un was appointed? There wouldn't be a thing we could do about it.

To clarify, the Conservation Advisory Board can only recommend rule/regulation changes and those must be sent to the DCNR Commissioner to be approved or denied. The only thing I know that has been denied in watching the CAB for 22 years is a dog hunting issue that Barnett Lawley did not sign while as Commissioner. Whatever the CAB recommends is not automatic. Everyone thinks it is, and usually what it votes-approves-recommends is approved and goes into effect. But the CAB is not the final say so. I may be wrong on this but I don't believe so. And if Congress gets into deciding about baiting we're screwed! The Legislature determines-votes-repeals-changes laws in Alabama, not agencies.

No. Most people do not recognize the difference between Laws and Regulations.....nor do they even stand up and fight when the Regulations surpass their legal constraints; as long as they agree with them.

So if the CAB makes a recommendation, it then goes to the Legislature and then to the Senate for approval?
No. CAB recommendations go to the Commissioner if it/they fall within the purview of the DCNR's ability to set seasons, bag limits and regulations. Regulations are different from laws. This is one reason there is conflict sometimes between a regulation and law. Laws go through the Legislature. A bill is sponsored, sent into committee where it may die or advance to the House or Senate floor where it may die or get a vote, etc., and then to the governor to be signed or let die on his desk.

With the impeachment proceedings going forward, I doubt the bill gets voted on this year. there is blood in the water down there and not much is gonna get done until this circus is over. my2cts
