I don't know the specifics of this case, but I don't see how anybody would be a policeman in this current society.

My wife and I were discussing it the other night. Low pay, having to deal with thugs and miscreants that want to kill you every day, dealing with domestic situations that should be handled by what most consider "adults". All of those things, and they try to hang you when an incident occurs like this one.

No way. Hayul naw. Ain't happening.

I could never do it. Some idiot would pull and knife and I would just blow him away.

Two reasons. You either want to serve and be a help to society or you want to rule and have power over others. The latter is the minority but still exist in large enough numbers that they cause problems for the citizens they are sworn to serve and protect and for the good officer's they work with. I wouldn't be too quick to condemn or exonerate the officer in question until the full truth comes out, whatever that is.

I had met the deceased a few times via his sister whom works with me. I had a feeling this one was going to be bad.

Kinda saw this coming too. Unfortunately, I doubt this will calm anybody down.

Why do you have an arrest warrant if there is no grand jury hearing yet??? Paging Doekiller for some procedural information. Is this a probable cause thing? Surprised the warrant is murder and not manslaughter??

It is my understanding you can arrest someone when a warrant is issued with probable cause and then go to the grand jury for indictment.

An indictment is not needed to arrest someone.
The normal procedure in Alabama is to get a n arrest warrant. The defendant has a right to demand a preliminary hearing where a judge hears evidence to determine if there is probable cause to send the case to the grand jury. If the judge determines there is probable cause, the case is sent to the grand jury. There the prosecutor presents his case (without input from the defendant or his attorney) and 99 times out of 100 gets an indictment.

Then the person is arraigned, enters a plea and the case moves forward if they don't plead guilty.

There are exceptions. Even if a judge finds no probable cause and dismisses the case, the prosecutor can still present the case to the grand jury and seek an indictment. The defendant just can't be held in jail during that time. They would be rearrested after they are indicted.

The other exception is used often in sexual abuse cases. The prosecutor can skip the district court all together and take the case directly to a grand jury. In that case, the person can not be arrested until there is an indictment.

It can take months for a grand jury term to begin or for the case to be reached by a grand jury. Sometimes over a year. So, there is no way a murder charge is going to be held until an indictment.

You take them to the Grand Jury if they are iffy or if you don't want to accept the responsibility of an arrest on your own. Like Charlie just said you can make the arrest first, with probable cause, and then if a judge agrees with you in a hearing (which the defense often waives) the case is bound over to a Grand Jury. The logic in this one for a quick arrest is probably the hope of it quashing any protests. Pretty obvious the guy did something wrong against policy.

I'm not jumping to conclusions here but I hope and pray the police officer was justified in using deadly force or the west side of Montgomery is going to look like Selma on a good day. If it can get any worse that is.

Also , Why did the DA of Montgomery county have to have a press conference announcing the arrest. ( TV time and thoughts of a higher office I'm guessing ) To me his office could have just sent out a press release instead of throwing more gas on the fire. He kept asking any questions? No. Any questions? No. Any questions?

I think we know why. To try and keep the natives from getting restless.

Selma looks like paradise now compared to the west side of Montgomery

Heard some details today on the incident. I won't go into many details as that is not my place to do that, but I will say that if what I'm told is true, there is no doubt this officer is being offered up as a sacrifice to appease the BLM crowd. The investigating agency (ABI) wanted to take the case to the Grand Jury, but the local DA is the one that insisted on an arrest.

There is a great size difference between the two with the officer being much smaller.

The man was not walking home from work or his girlfriend's at 3AM. He had been at a shot house playing cards.

The officer had exhausted all his means of non lethal force (taser and pepper spray) and for lack of a better term, had gotten his ass whipped and was lying on the ground when the man ran on a porch and retrieved a metal paint roller extension pole and was coming back to the officer. The officer shot him 5 times, which is probably the justification for the charge. (overkill).

No video as the vidmic's battery was dead. The mayor acknowledges that he could have gotten the camera batteries with a longer life but he went the cheap route.

It will all come out in the end. I hope justice is served and political pressure or threats of riots are not a part of the final decision.

I wish a defender with some balls would help the poor officer out here.

Just saw on the news where he's got one and he's saying the right things right now. There is also a fund set up to help him with the fees, etc.

If they were trying to appease the blm crowd with an arrest, and he winds up being found not guilty, it is probably going to be even worse

The big hope is that the blm movement pretty much dies out by then and the DA hopes he's gotten his appointment to a federal judgeship from Hillary before then. I agree he was not thinking big picture, just keeping it calm for the moment and be seen as a hero for keeping the city from burning (for the time being).
