I am thankful that JWC kept after this and got a wrong righted.
I am also very thankful that new legal precedence seems to be in effect for night hunting. It has been very messed up in this state for a while now with virtually no evidence needed other than a GW's word.
Back when the spotlight laws changed, I know of a guy convicted of night hunting and all they did was turn around on a dirt road at night, this caused the headlights (no spotlight) to illuminate deer in a field and they had a rifle in the truck with them. The GW said they were hunting (no shot fired).
Just like the thre boys situation, this could be applied to almost everyone of us on this forum each time we go hunting. Has the Supreme Court ruling changed the law now to require more evidence from the State in these type cases now?

He was found guilty for two reasons, 1. he was a known outlaw, and 2. he was absolutely hunting. That was the only way his sorry butt could kill a deer.

Examples like these just demonstrate why common sense coupled with the proper and wise use of discretion that is afforded to LEOs is so important.

I told this story in a previous thread but in the mid 90s I was pulling out of my driveway at my house and was pulled over and arrested for night hunting because my headlights shined into my neighbors field.Game warden was a complete asshole! Only gun I had was a handgun that I had a ccp for.Ended up costing me about $800.00 for lawyer fees even though judge threw the case out so don't think it cant happen to you.

Why would one of them say they were guilty? If all three didn't do it then none of them are going to come forward to save the other two. No aldeer jury needs to hear this case to know some retired gw was playing cop and used his former title and reputation to get these three charged. This whole thing was messed up from the start and sounds like the pos ex-gw needs to quit playing mr.cop. Cause with the charges they gave the gun back and they are suppose to confiscate it till trail. As far as the judges they went off of what the sheriff deputy and ex pos gw told them and gave them way to much credit. So they check the gun and it smells like it just had been cleaned so the kids fired it and broke out a cleaning kit in the vehicle and cleaned it before said pos pulled in behind them to block them in till the law got there. By all means surely you have the common sense to know that doesn't add up.
