SAME asshole GW that wrote the tickets - shortly thereafter - shot a doe with a bow - 30' up in a tree - on the prosecutor's (FRIEND'S!) property... THEN promptly unbuckled his safety harness and feel 30' out of the F'ing tree! Broke his back, had to have the prosecutor buddy bring in the ambulance to rescue his sorry ass... And said GW was also a Hunter Safety Instructor!
Where is this article?? I mean...if this is true...involving a GW...there must be documentation for this... Please post.... I wanna see where this happened....

I'm still trying to figure out how the retired GW came up with all those charges based off the info stated, much less the fact that they were found guilty. Did they not testify to the fact that they did nothing wrong or that no evidence was provided to support the charges. Again, just has me baffled.

Oscar, it's one thing to complain about citations. What was your story about the youths and GW?
But ragging on a guy -- ANY guy -- falling from a treestand, almost dying and leaving a wife and kids, ain't right.

You think you are baffled... you should try sitting in the courtroom watching this happen.

Oscarflyer: I Know all involved in the story, but the offenders, bout all you got right was he fell. Strap on the stand broke as he was entering it. Never got to hunt that day. As to who owns the land, well he had premission to hunt there for years. Just what ticket did he issue that has you feathers ruffled. He always seems fair to me, by to book but fair.

I would say its more than likely the boys did something wrong. How else would this retired officer pick out their car. He just picked a random car and called the sheriff on them for making a complete stop at a stop sign. And just happened to pick the correct random car, which happened to have guns in it and boys actually going hunting. When I was that age i did some pretty dumb stuff, my motto was always "deny till you die".

Fred - I have a question for you. From what we saw from the case above I mentioned...
A GW gets a portion of the 'proceeds' from a guilty conviction/fees for a game violation!?! True or False? NOT TRUE AT ALL...a GW gets a salery from the Dept, thats all. No bonus for cases made, convicted, or anything.
I've spent most of the money I've made in my lifetime on hunting and fishing. The rest I just wasted.....

At this point he said that if the boys plead guilty we could appeal (which is not true- only for a lighter sentence) or we could go to trial but that oneonta the charges had 6 months in jail which she could impose. I wonder what county this happened in? Lowndes How does this case get from Oneonta to Lowndes County or vice versa?

I hope when you win the appeal that there is recourse that you can sue the retired game warden. What you have described is a crock of crap.

So, True or false.
The case was in Lowndes county.
They had a trial in District Court and were found guilty.
They appealed to circuit court.
They were told they could plead guilty and appeal for a lower sentence.
They were told the judge would give them 6 months.
They had a trial in circuit court and were found guilty again.
You have ordered the transcript and you are appealing again.
What is true and what is false?

We found it when we were researching things. Thanx for the feedback.

If the details I got were incorrect, I apologize. They are as they were related to me from people who knew the incident, individuals, etc. And I don't advocate anyone getting hurt. It is the fact that he was a safety instructor. But accidents do happen...

Sounds like you should be able to prove it if it is in the "books".

But I have seen it written otherwise. I can't prove that it happens, but it is on the books. We found it when we were researching things. You're asserting that law enforcement agents receive a portion of the fines from cases they bring forth if a conviction is made. Let's see the proof, or "the books" or whatever. This goes to the heart of the longtime anecdotal "they only write tickets for the money!" claims and if it's somewhere "on the books" then let's see it. Certainly would be interesting to read and know about.

I want to clear up something, I reviewed the YO statute. The fine allowed is the same as for the underlying offense, or $1,000.00. So, the fines would not be incorrect for the charges.

What is true and what is false? TRUE - The case was in Lowndes County TRUE - They had a trial in District Court and were found guilty. TRUE - They appealed to Circuit Court We were urged to plead guilty because one of the charges carried a 6 month jail term and if they were found guilty the Judge could impose the 6 month sentence. He also said that if we plead guilty we could still appeal. TRUE - They had a trial in Circuit Court and were found guilty again. TRUE - I am getting a copy of the transcripts. Have spoken with the Court Reporter and he is to call me when they are ready. TRUE- We are appealing again...

It was 7:00 at night.. there were very 2 vehicles on the road, them and the vehicle they were waiting on to pass before they made their left hand turn.
They were NOT going hunting but in fact were sent out there by one of the boys mothers, to drop off groceries and pick up a broken pantry door. She even had ordered pizza expecting them back in 30-45 minutes.
The Retired GW claims he "heard" the shot, and testified in court that he did not see it nor did he find any shell casing on the ground.
The boys never got out the truck, were not dressed in camo and had no spot lights or flash lights with them.
Remember, both deputy sheriffs testified in court that they searched the truck and did not find any shell casing inside the truck nor could they say that the gun had been fired. They returned the gun to the boys and told them they were free to go. The truck remained in the site of the retired GW the entire time, as he had them blocked in and refused to let them leave until deputies arrived.
