The law says you have to believe your life is in jeopardy, not that you are actually in jeopardy. Same as someone pointing a toy gun at you. It's what you believe at the time and the totality of the circumstances.

There isnt a good way out of this one. but i would have been so close to him that if he moved i could have wacked him in the head with the gun and turned his lights out. then i would let the police take his but out of there.

Well, looks like if the girl was in "HARMS WAY" she would have screamed, yelled, been crying or something. I wouldn't have resulted in shooting the boy, I would have taken a stick or a belt and beat the piss out of both of them. BUT i really dont worry about getting shot or protecting my self much, hell my house doors hasnt been locked in a year probably. It's a sad situation for both families. I would really hate to know that it was my son that was on the receiving end of that deal... Pray for both families is about all you can do....

I also think the dad should have used some common sense. just my opinion

The stories of what happened are changing. I only commented on the info that was presented and based on that, the daughter and dad were in the wrong and should face punishment both criminally and in civil court.

Negative. I wouldn't have dreamed of sneakin in my GF , now my wife, house at any time. Especially not at 2am.

Hey einstein, when you're trespassing into someone's home at 2am and the owner of the house has a bead on you and tells you "don't move", you don't move. He wasn't shot for "no reason". He was shot because he didn't follow a command, at gunpoint, while trespassing in another man's house.

I just don't see why this guy isn't getting it... YES I would shoot any person in my house at 2 am if I didn't know their intent and didn't know them. This man was protecting himself and his family. I don't see where he did anything wrong, but then again you are from Florida and probably a transplant Yankee so it explains quite a bit.

WhiteCityHunter is Monday morning Quarterbacking with facts or a different set of facts that were not available to the father at the time the incident occurred.
Just because you visited your GF in the wee hours of the morning has no bearing on the subject, the father DID NOT KNOW it was her BF visiting her in the wee hours as WhiteCityHunter seems to be implying that he knew all along it was.
I wonder at what point WhiteCityHunter would use deadly force to protect his family? After they are Rape, beaten or killed is too late.

My youngest sister was molested in her bedroom when she was 5 and she didn't scream or yell out. It was the next morning when my Mom found blood in her bed that it was discovered that she had been molested and the pervert that did it was a family friend but he scared her so bad it took 2 weeks to finally convenience her nobody was gonna kill her family if she told who it was.

he only got 2 years and two ass whippings from hell, one from my Dad and Brother and another from the Deputies that arrested him....he resisted.

To me it would depend on his BAC, if it was .08 or so, it should not matter.

If it was .15 or higher, you need to take his memory (or possibly lack thereof) into account.

Controlled substances (not of his own scrip or not conducive with a blood test compared to his prescription), all bets are off.

Why does this have anything to do with the boy getting shot? I'll take that bet.

if I was the father I would have done the same. if the daughter said she didn't know the guy you don't ask questions. you protect you daughter by all means. you have to think in less than second of what to do to protect your family. any more time than that it gives the intruder time to react and could mean a family member or your life. hate it for them because now the dad will have to live with the fact he took a life and the daughter because she lied caused this boy to die. it will be hard on both of them. but if I was the father I would pulled the trigger.

You got that right. If I ask who they are and she tells me she has no idea, it becomes a shoot-first-ask-later scenario if they don't do exactly as I say.

Me too.

If you're in my daughters room at 2 am and I come in and ask who's in there, you better answer and be begging for forgiveness and mercy.

No I never did sneak into a gf's house/room. Why....I'm not a damn idiot. People get shot messing with wife's and daughters.
