Dad shoots intruder in daughters room

I'm no 49'er but I'm thinking that the daughter might be in some sort of a situation, legalese speaking of course.

I think dad gets charged with a lesser murder charge or manslaughter. seems like he had the situation under control then got antsy on the trigger. BTW- I got 2 daughters and I have been that 16 yr old boy too...

IF the girl would've told the truth, that probably would've ended much differently. Sad situation.

I agree with this. Not sure how else the father could have handled it. She said she didn't know him. He told him not to move. He moved as to grab something. As far as the father knew he was reaching for a gun. Sad situation. I've never sneaked into a girls room without her parents knowing. I was too scared of getting shot. Just sayin...

Can't wait to hear the liberal response, "They were just happy teenagers having SEX! He didn't deserve to be killed by a trigger-happy gun owner! Guns are horrible!"

And, some will say that. Because they're Godless morons or don't have kids, or both.

If a Grand Jury indicts this father I'll be surprised. Defending his home and family, first and foremost, after giving fair warning and receiving info from his daughter (despite her lying to him).

Bad deal.

Second degree murder for the dad. No reason to shoot the boy when a member of the household allowed him inside.

Daughter gets charged as an accomplice to murder.

It's not self defense, and no threats were made. Boy didn't break in either. This won't end well for dad and daughter.

The father didn't know he had been invited/let in at the time of the shooting did he?

I think you have to go on what info the Dad had at the moment. As far as he knew it was a break in and I think Tejas has the Castle Doctrine. He may walk but they get the daughter on some sort of manslaughter type charge.

A break in where the intruder is in bed with the daughter and the daughter invited him in? Don't think so. I just can't see where any of the self defense laws can support the actions of the father. No threats to ANYBODY in the house but he shoots the kid. Not seeing how this is self defense in any way.

It will be interesting to see why he was taken to the hospital for non-medical condition. I assume to test for sobriety. If he was drunk or on drugs it is going to weigh negatively for him.

There really isnt enough in the story to figure it out. The story also says the father went to the ER after the incident for an "unrelated" matter.
I read that as he was having a panic-attack when he realized the full situation, like he might have been half drunk/half asleep when it all went down.

The daughter first claimed that she didn't know the person and that they weren't in bed. He told the kid not to move and the kid (supposedly) did move and got shot.

I wasn't there so I'm just speculating but IF there is a stranger in my daughters room at 0200 then his ass better freeze when I say freeze. I gotta tell you, having been to Houston that would be one hair trigger too. Also having been that teenager I would have been so "froze" they'd have to take me out of that neighborhood with a set of hand-trucks.

Probably a dozen different ways it could have turned out with this one being one of the most tragic.

I agree. I presume he was woken by another child from a sound sleeping saying a man was in his other child's room. I have no idea how fast the interaction took place. I have no way to know how the teen responded to the father. Best thing is NOT to be in a man's daughter's room at 2:00 AM in the morning.

If a stranger is in my house and my family member say/says they don't know him, he's a threat until I figure out otherwise. End of discussion.

You got that right. If I ask who they are and she tells me she has no idea, it becomes a shoot-first-ask-later scenario if they don't do exactly as I say.

I have a daughter, and like most dad's I'm protective of her. However if I walk into her room at night and a boy is in bed with her, but she says she doesn't know him, then I gotta question my daughter. No screaming, no struggle, just laying there sleeping. None of that adds up to intruder/rapist/burglar to me. She is the responsible party along with the over reactive dad.
I just don't see where the dad or daughter have a case at all. And all y'all internet Badasses that say shoot first, ask questions later. I'll visit y'all at the state pen cuz that's where most people that follow that mantra end up.

As the father of two daughters, I fail to see the problem with this story.

Even if she tells the truth it doesn't mean he isn't a threat since the father doesn't know him either.
