I'd turn the feeders off and tell the other members to get over it.

Turn them back on after season.

Well, the problem with the feeders being out is that the guy that placed them has effectively closed off part of the hunting club for any other member that is still hunting. That would not set well with me. I assume he paid the same amount to join the club as the other guys did, therefore he paid to hunt the entire club for the entire season.

Your buddy shouldn't have to be figuring out where he can hunt and still be legal on a piece of property that he paid for full hunting rights on.

I don't think that would make it legal to hunt near them, but maybe BhamFred will chime in on this.

I'd turn them off, shovel up whatever corn is on the ground and hunt somewhere else.

Thanks for all info and suggestions.He has called one of the members and told him he will be going up to the property and turning the feeders off and cleaning up whatever is on the ground. He will not hunt the property until next weekend and when the season is over he will turn the feeders back on. Thanks again for all the info.

a turned off feeder CAN be legal to hunt over IF the deer cannot get to the feed AND there is no feed on the ground for 10 days...

a feeder full of corn isn't necessarily illegal to hunt ove under those conditions, but ya might have to do some splaining to the local GW

That's exactly what is going to be done. He is also taken pics as he does it. What is the fine for a first time baiting ticket. Is going to court mandatory or can you just pay the fine thur the mail. Just in case he was to get a ticket he knows how much to deduct from his club dues. Lol

1. he knows there is bate...they told him, which means that even if he doesn't know exactly where it is I bet if he hunted close to it and was caught he would be guilty b/c judge could say he should have found out where the bait was, since he knew it was on the property.

2. like someone else said, if I didn't want to hunt over bait and was in a club, then I would not put up with people putting out bait before the end of the season. They are basically prohibiting him from hunting any areas they bait. How is that fair?

no way that would hold up. I would say any property over 500 acres you could easily have a feeder or two out and not be prosecuted for hunting illegally, assuming you are a long ways from the feeder.

Just another FYI. Here we go again, but I was told by a now former warden that taping, sealing, up the feeders would'nt cut it. The feeder had to be EMPTY. I guess there is a lot of room for interpretation.

it isn't bait if the game won't eat it. A pile of bricks isn't bait. A pile of dead fish isn't deer bait. if deer won't eat it, then it cannot be bait......

BFred, a friend of mine in Russell County was fined $500 for "hunting over bait" because the GW used his knife and dug out a molded 1/2 kernel of corn that was wedged deep between two boards in a trough feeder. My friend does not feed during the season and no corn had been in that feeder for months.

Is this legit or is this GW just being a pecker head? What will the judge say at court time if my friend disputes it?

Point is, you better remove 100% of the evidence or you could get dinged depending on the GW.

I always hated any law officer than is too stupid or lazy to actually READ and COMPREHEND the actual law they are paid to enforce. No excuse for it.

It's like the permit law where one says that a person is in violation of the law if they don't have WRITTEN PERMISSION ON THEM to hunt that property. BS, read the damn law......guest of the landowner dosen't have to have written permission. No definition of guest included.

if that is all the evidence then he is just being a ass, and is too damn lazy to make a proper case. I'd plead not guilty in District Court and if I lost I'd appeal that conviction to Circuit Court. Some District Court judges can be as lazy as some GWs.....

what if someone was to hunt over a feeder and then decide they wanted to hunt legally, so they sealed off the feeder, next day hunt the feeder and a game warden happened to check them? Doesn't bait have to be completely removed from the area 10 days or more prior to hunting that area? Not arguing, just asking but in that situation it would come down to when the feeder was sealed off.
