I was hunting with a friend of mine at his club this weekend.After the hunt on Sunday morning there was a group of members letting my friend know that this is the last time they would be deer hunting for the season.They also were letting him know that they would be setting up feeders with cameras over them so they could see what bucks made it thur the rest of the season and they would be back in a couple of months to retrieve the cameras. The club is about 800 hundred acres with 9 members with 7 of them not returning to hunt. I'm not sure if my friend knows where or how many feeders would be set up and I didn't want to ask any questions being a guest. Now the real question. If a GW would to find these feeders with no one hunting over them but found people hunting the property would he charge them with baiting.

From what I have been told by several different GW's is that this is left to interpretaion by the GW on hand. I have been told that feeding is not nor has ever been illegal. Baiting on the other hand (as we all no) is not allowed in the state of Alabama. I have had a GW say no bait/feed on property at the same time hunting is going on period. Have also been told (by a different GW) that if the feed (since it has to be interpreted as feed and not bait)is with-in a resonable distance (another intrepretation) from any given stand and no one walks or drives by the feed with a weapon for hunting that it would be ok. This as you see can become a very sticky situation.

Option 1: Would be to contact the GW that actually works this area and get his interpretation of the law since he is the one that would or would not be writing the ticket. I would be doing this immediately due the amount of days left in the season (if GW says no...there has to be a 10 day window after all feed/bait is removed before hunting can resume).

Option 2: Keep quite and hunt. Better to ask for forgiveness than beg for permission.

Option 3: Tell fellow members that are not returning to wait until season is over because there are still those that will be hunting. They are more than welcome to return on Feb. 1 and put out all the corn and cameras they want. If they choose not to comply see option 1 or 2 and begin to look for other members that are not so selfish.

The baiting arrest procedure from the dept is based on the Phillips case before the Al Supreme Court. The arresting officer has to be able to prove that the hunter knew or should of known about the bait when hunting. Bait that is hundreds of yards away is not enough to make a case stick on, just having bait on a property is not enough, on it's own, to make a bait case stick.

me ,,,if i was a paying memeber i would not go along with this .

just because they won't be hunting there's no reason to possible screw me up one way or another . i would though gladly fill the feeders with there corn and turn on the cams after season

I agree with Frankie! No reason for there issue to become mine. However me helping out a fellow member to save him a long trip is completely different.

My guess is that if your buddy gets a ticket they won't pay it for him...

I'd be furious!!!! We can't hunt anymore so no one else can.....screw that!!! If I paid for deer season, I would be paying for Oct 15-Jan, not Oct 15 thru when the "group" could no longer hunt and the remaining two or three had to jump thru their hoops. Although pretty smart on the groups part bc he can't legally hunt......they're Di#$'s but pretty clever


Give me bout 15 more minutes, I was dreamin about beavers..........

Crap!!!! I agree with turf- if i paid for deer season you would have to beat me off the place til Jan 31.

Also- I've been told face to face with a GW that if "bait" is on the property you are hunting, then you are hunting over bait... however, it IS up to their discretion.

It was the 09-10 season in north shelby....i could even name the officer- who is no longer in shelby...

of course took it for writing in stone since it came from a GW's mouth.

You will find that once you get to Court, there are a good many GW's that simply are not well-versed on the Law.

They usually get better as they get older and have more experience in Court themselves. And, unfortunately, the sheer vagueness of many of AL's Laws leads to this problem!

Gws will also tell you chit they know isn't correct...like the baiting regs/laws.

We recieved a written policy/procedure on making bait arrests. The arresting officer MUST be able to prove the hunter knew or SHOULD OF KNOWN about the bait.

Update. Just talked to my buddy. He was already in contact with a member that had knowledge of where the 2 feeders where placed. He has located the feeders and determined that he hunts about 800 yards from the closets feeder. Now that he knows about the feeders is he automatically in violation even though he is not hunting over them . Looks like he is going to hunt another place for the rest of the season. He said he will wait until next season when baiting gets passed. Lol.

Aside from all the laws. If they have feed out they are going to draw deer to the feeders. This can affect your friend (member) hunting for the rest of the year. Does love corn and bucks love does. Not a good situation for anyone.If i had paid my money those feeders would dissapear at least till febuary
