Do you understand that when her lawyers entered the Not Guilty by Reason of Insanity they were basically stipulating to the fact that she did it? That is not in question so forget about the husband.
The problem is Massachusetts law which places the burden on the prosecution to prove that she was sane, whereas every other state put the burden on the defense to prove the defendant was insane by the McNaughton Rule. I still maintain she'll probably end up walking because of the quirky Mass. law. If jurors follow the law it would be hard to get a conviction, but at the same time, it will be hard to find 12 people willing to let an admitted child killer walk. Every time it is tried will likely end in a mistrial. Eventually the prosecution will just throw their hands up and give up or agree to some kind of plea that favors the defendant. After this is over I bet there is a move up there to change the quirk in Mass. law to go along with the rest of the U.S..
