By the looks of that video clip it does not look like stand your ground because he never went towards her and did not have a weapon. Pwyse all she had to do was walk away. Instead she had already pulled the gun. I think she had already made her mind up when the first words were spewed. I agree she could have avoided it. No doubt they both could have. All she had to do was walk away and all he had to do was walk away. I’m not sure you watched the same video as me though. When he rounds the corner of the white car he turns and faces her and takes two steps directly towards her. Whether he had a weapon or not doesn’t matter. The whole actual premise behind “stand your ground” is that you don’t have to walk away. You have no legal duty to retreat from a threat before you use deadly force. He walked towards her obviously threatening her, she stood her ground. Could it have been avoided? Yes of course, by both sides. But that’s not what stand your ground is about. This is from AI explaining Florida Statutes § 776.012 and § 776.013 what constitutes a legal stand your ground scenario. Lawful Presence: You must be in a place where you have a legal right to be (e.g., a public sidewalk, a business, your vehicle, or your home) and you cannot be engaged in illegal activity at the time. Reasonable Belief: You must reasonably believe that using force is necessary to defend against the imminent use of unlawful force. Threshold for Deadly Force: You can only resort to deadly force if you reasonably believe it is immediately necessary to prevent imminent death, great bodily harm, or the imminent commission of a forcible felony (such as robbery, burglary, carjacking, or aggravated assault).

Watch both videos....he was walking right at her and was within a few feet when she shot him. Let's see: The woman retreated despite not being required to do so under Florida law. She told the advancing man to stay away from her. He continued to advance while she was pointing her gun at him. What intent would you perceive if a person kept coming at you after telling him to back off while you had him at gunpoint? The lady cooperated with police, gave a statement and was released. I expect she won't be charged, and if Florida does so, she won't be convicted even if the jury is all racist white men.

I saw one video that said she got out of her car with her pistol already drawn. I have no clue if that’s true, but it does detract from the “self-defense” argument a little. She looked like she’s done this before.
