No get ready for the appeal under the Batson Rule. I think the defense attorney would have had to raised an objection to the juror strike based on Batson during the selection process? Don't know if they did that? All the furor over an all white jury when both sides participate in the selection. The judge shouldn't have allowed an all white juror. It's a complete waste of time and there will definitely be a re-trial. Maybe it was a defense strategy to see the case knowing they would get a 2nd shot. It wasn't all white, but there were no blacks. 3 prospective black jurors were dismissed because they openly disqualified themselves. It's all in the records.
