I was kind of waiting for this and Skinny touched on it for me. I was waiting for everyone to start screaming Hate Crime, which it may well be, but proving it is the issue. Just because you were assaulted by another race, does not mean you can prove a statutory Hate Crime. People have a hard time understanding this concept because it is not what they want the situation to be.
To prove a Hate Crime you have to show that the Crime was not only committed on a person of another race, but that the crime was committed because the person was another race. Because being the operational term. What may seem obvious to you or me, without the evidence, it is a no go on Hate Crime prosecution. You have to have evidence that they said, wrote, or somehow communicated that they were intending to assault a person of another race prior to the offense. Trust me, I've tried to explain this a million times in my role at the Selma PD. A lot of people fail to grasp this or just don't want to grasp it.
