What's the deal with damages when a neighbor's tree is fully growing on their property but is not kept properly then falls on your home and fences in a city? Thanks>Moss

I think it's an act of God and your insurance is responsible.

Unless your mom has discussed concern with that particular tree with the neighbor previously, she will be liable. That's been my understanding in the past anyway

Where it lands, the owner of that property owns the tree. At the property line, your mom owns whats on her side now. If its laying on a fence or structure, or blocking the driveway, her insurance should pay for what is on her property. Shouldnt make her premium go up since its a act of God, nature event, nobodys fault.

Letter must state that the tree is a "Hazard" in it's current condition ie: leaning significantly, rotten etc. Healthy, straight tree on other side of fence doesn't count.

yep even with a letter i would think that you would have to prove that a storm didn't cause it

Each owner is responsible for their own side. That's the way it's always been. Sucks, but it is what it is.
