Maybe someone with utility experience or one of the attorneys on here can answer this for me.

Can a municipality deny you a connection to a public water main that runs through your property when every other structure on the road is connected just because you plan to use it for a business ( not a huge volume situation)

Is the property zoned for what your doing? Are you on city sewer or septic?

Even if they can't they can charge enough to connect to make it unrealistic. But then when you talk to the person one level up the food chain it is easy peasy. Can you come off another structure?

No, the municipality in question just refuses to set a meter period and the only reason is that they don’t wanna sell me water. I could run water from the other side of the property, over a mile, and that would come from a different municipality. I could do that but if it’s possible I’d rather spend twice as much to make them do the right damn thing and not just have the power to pick and choose who they serve.

They gonna have to give a better reason than that, an im just speaking from my experience, an this very thing is what i do..you can refuse service for about any GOOD reason, bein a certain distance, or the line already being overwhelmed. Some utilities are forced through city councils, by laws or ordinances to refuse service in certain circumstances. It can get technical, but just refusing to give you service because they just dont want to..that dont really happen much…not without a reason. If the line that is running through your property is is a fire service…its not technically supposed to be tapped for commercial or residential use anyway..but it happens…if it is an old line that has taps and fire service on it, they may have a policy to not add anymore due to fire flow…i have no idea, im just givin you some ideas. In most cases, if you got the scratch and are willing to pay material and impact fees…they will hook you up. This is odd to me, but its different everywhere you go…i know for a fact…we dont just refuse to serve people cause…meh…we dont want you to have water. Hate your dealin with this.

The line had a meter servicing the property when I bought it. I discussed my plans with the provider and discussed changing it to a 2inch commercial meter before I spent $1.5m on the project and when it came time for water they not only decided not to give me a larger meter but disconnected the existing one.

Water is big money. Water departments, boards, authorities can become like the mafia. Surely they had a better reason than “screw you”. Plead your case to whomever will listen then hire legal counsel

I thought water departments never turned down service. They set the price on the material, install, and then sell you water. Why would they cut you off

Sounds to me like your project may be in direct competition with or has the potential to hurt someone’s existing business, and that someone is family, a friend, a friend of a friend, or somehow otherwise politically connected. That’s usually why situations like this arise.

Be nice to start with and work your way up the chain of command until there is nowhere else to go. At that point, If the line has available capacity, you’re zoned correctly, and precedence is set with other surrounding commercial properties on the same line, sue them all and then make them famous.

It’s a standard meter in place

A well is already there but not dependable enough
Originally I was told they weren’t sure the line had capacity so I offered to pay to run a mile of 4 inch from a 6 inch trunk line. Not only would that supply me plenty but would increase supply beyond me for growth
Then they just decided they didn’t wanna sell me water and disconnected the existing meter
I know for a fact several meters have been set past me since this started and nobody has any pressure complaints that I have talked to and that’s everybody I’m pretty sure.

I could easily run ample water from the other side of the property supplied by Fayette but why the hell should I, they only have power trips and hidden agendas, which I absolutely believe to be the case but won’t share why just yet, if sheep let them. I ain’t wearing wool for anything or anyone
