I represented a guy for shooting a human. My guy was an uninvited guest at a party. A partygoer threw a beer bottle and hit my client in the head, my client pulled out a .380 and shot the guy in the abdomen. My guy spent the night in jail. He didn’t go to prison and he has almost finished his probation.
I can shoot a doe off of the side of the road this afternoon and it won’t be a big deal. If I shoot a 180” buck on the side of the road and post pics on social media then everyone with deer cam pics of the buck will go crazy.
Smart poachers don’t post pics of their kills on social media. Smarter poachers make sure their location and meta data is turned off on their cell phones. The smartest poachers don’t carry cell phones and don’t take pictures.
I’ve represented several poachers, I’ve won almost all of those cases.
I’m not condoning their actions, it just pays the bills.

All free-range game animals belong to the State. The State dictates seasons and bag limits. The poacher killed a deer that belonged to the State of Ohio, he just so happened to kill it on property that he didn’t have permission to be on.
He will do it again.
The year before this kill he killed a 151” 8 point on the SAME property. He was fined $5,000 for that deer.
No need getting all riled up because you either agree or disagree with it.
No black bear season here in Alabama. It is a misdemeanor to kill one, go figure. My take is that he didn’t steal the deer from the landowner, he stole the opportunity to take that deer from the landowner (and others in the surrounding area). The landowner also possesses (or did) exclusive hunting access on his own land. He also stole the “exclusive” part from the landowner.

It's not the landowner's deer. The deer belong to the state.
True, but the landowner was denied possible income from leasing his property for someone to legally harvest that buck. Sounds like a civil issue to me.

There's not many things I've ever had to do that are more stressful than confronting an armed trespasser. You know that the guy is crazy in some way, or he wouldn't be an armed trespasser. You never know when confronting one is going to turn into a gun fight, and there is no good outcome when that happens. I know of several that turned into shootings, one of them a friend. The poacher nearly beat him to death and he ended up having to shoot him. Then the POS district attorney charged him and he had to go to trial. The jury deliberated a few minutes before finding him not guilty, but it was a terrible thing that he had to go through. All so that some egotistical, entitled outlaw could take a shortcut to getting a deer. Being an armed trespasser is a felony in Florida. I predict that it will be in Alabama eventually. In fact, I'm gonna contact my Alfa people and see if we can't get that on the legislative agenda. Maybe the Trumpian era will be the time when we can start putting poachers behind bars where they belong. The Soros lawyers won't like it, but I sense they are vulnerable right now.
