If it's a lie I had two sisters tell it. Even if it had slipped her mind they should have still told her . This is crazy

Im just saying its either real debt or not. If it turns out to be real, shes either not being completely honest with you about it or she just forgot about it somehow. I dont think ive ever forgot something like that. If it involves an ex, she may or may not know about it. If it happened before they divorced, i would think it belongs to both of them, whether she knew about it or not, comminity property type of deal. If he borrowed the money without telling her, that sux for her but it is what it is.

Yes , but they still have to tell her what the debt is for . My other sister was setting there with her when she ask about the debt . So its not if she being honest or not.

Not sure why the bank would know the cause of the debt. Maybe someone wrote a check for more money or an autopayment came through and not enough money in account. Sounds like an old account is overdrawn and she just needs to settle the debt. Could be hers or her husband (is he an ex) it would need to be cleared before she can get an account.

I wouldn't get mad at the bank since they are the ones who have money owed to them. I can't blame them for not opening a new account until and old debt is repaid.

Sounds like an issue with either her or her husband/ex or both.

What amount are we talking about.....less than $100 or $1,000's of dollars. If a small amount I would pay and open the account.

What we'll be finding out next week one way or another . I'll sue them into the ground if I need too .

It may be that other banks just do not know why she has a debt at one that is not them. I suspect that if she knows what banking institutions she has used in the past and calls until she gets the one that has the debt that they can tell her what it is for - my hunch would be unpaid NSF fees or something similar.

No no . She went to the bank where the debt is . They told her the amount just not what it was for. She wouldn't pay . But she can't get a account any where else till the debt is taking care of

That seems weird. Did she ever co-sign for anyone? If they claim that she is responsible for the debt, then they should have to show proof of what the debt is and how her name is associated with it.

Yeah have ever right to be mad. Bank can't just say you owe money and not tell you what its for . Hell had she not try to open a account at another bank she still wouldn't know about it

It’s probably labeled in the bank’s system as ‘personal loan’ or something to that effect, so the teller or whoever you spoke with wouldn’t be able to tell the purpose/collateral without looki by at a Note, application, credit determination, etc

I’d start by asking for copies of those documents and going from there. Also the credit report will tell you when the account was opened, whether it was an individual or joint account, etc

The bank should also be able to tell her when the last payment on the note was and how much of what is owed is actually late fees, etc.

I am curious as to how y'all know it is a loan but the bank did not tell her anything. Or was that she had an outstanding debt on a loan all that they told her? As in they couldn't tell her what the loan was for?

Ask what mailing address is on file, since that would be where the bank had sent statements and past due notices. Requesting a copy of the most recent statement would also show names on the account and when it was opened, which may jog her memory

Something to think about… if it was an unsecured small loan the bank won’t have a clue why the money was borrowed. If there were any collateral securing the debt (car loan, equity line, business loan, construction line, etc. .) they would have come after that instead.

Requesting copies of the Note, application, credit/underwriting determination would explain everything (who took out the loan, when they took it out, purpose of loan, etc). And finding out where the bank has been sending correspondences to would explain why this has gone on as long as it has.

Then why not say it was a personal loan . Why not just say ,,,, this was a personal loan taken out by you on such and such date for the amount of such and such and there is a balance of such and such

Why ,,,,, I can't tell you . Never was a I don't know just I can't tell you . I ask my two sisters a few questions and was left very confused. I've never even heard of this happening
