I’m assuming but I thought I understood purple paint to be trespass law and posted property is for hunting

We hunted a duck hole we called the trucking company. It was in N Courtland and the landowner would not write permission but allowed hunting. Fortunately back then not many duck hunted.

As far as Arkansas back then. We knew and talked to landowners and all told us we could sneak fields that didn’t have purple markings. Barrels usually and or painted trees when around. We knew folks in Fair Oaks and Brinkley so we burnt a lot of gas back then keeping the roads hot.

Personally I couldn’t imagine going on someone else’s land and declaring I have a legal right to hunt there. Public land sure, private land I lease absolutely. Different strokes for different folks I guess. It’s still in the spirit of hotfooting in my opinion.

Rule 220-2-.85

(2) ā€œOpen Permit-Public Landā€ is defined as governmentally owned land open for public hunting and/or lands made available to the public on an individual basis whether for a fee or not. Examples of such lands would be national forest lands, lands owned by lumber companies and utility companies available for use by hunters either through free permits, fee permits or no permit requirement.

I use the ACE Hardware brand of parking lot marking paint in handicap blue.
It lasts a looong time, especially if you blaze the trees prior to painting.

To the best of my knowledge vacant land that is painted purple in complete adherence to that statute can no longer be considered ā€œopen fieldsā€ [doctrine] so a game warden cannot enter without a warrant, land owners permission, or reasonable suspicion that a game law is being broken. Maybe some of our law enforcement officers can speak to this.

Wrong. Any land falls under the open field doctrine. You may be thinking about the case in TN, but that was a TN case and has not made it through the appeals courts to make it applicable to Alabama yet, if it does at all.

I guess I should point out that I certainly don't follow this type news like I used to, so things may be different now, but I'm confident that I would have heard it if it were.

Jawbone I think you would have a pretty dang hard time proving that all land falls under that doctrine. There have also been cases adjudicated that do place limits on the governments usage of that law other than the new case in Tennessee.

Well tell me because the only land that doesn't fall under the Open Field Doctrine is land that is within the curtilage of a building.

Purple paint, No Trespassing signs or even signs saying Game Wardens keep out can't keep them from legally coming onto your property in performance of their duties.

our timber company uses blue for trees to cut, If there wasn't any purple on the trees, I'd just assume it was timber company markings.

Dear Piddlers:

If you don't own the property or have permission to be there..... you are trespassing. Period. If it's my piece of property you and I can talk about any loopholes in the law with the Sheriff's Deputy and if necessary the local Judge.

If you are a habitual line stepper I will go to the court and file something, whatever it takes.

Stop trying to hide behind a poorly written law. You know exactly what you are doing.

STOP TRESPASSING

That's interesting. I was told just the opposite by a GW. Our plant is adjacent to the local airport. The airport was having trouble with deer on the runways. I went to the lady who then managed the airport and asked for permission to hunt it (bow only, inside the city limits). She was tickled for me to hunt it. However, when I told her I needed a written permit, she refused. That afternoon, I ran into the local warden in town and ran the situation by him. He plainly told me if he caught me hunting there, I would be cited.

The law you're calling "poorly written" is the law that defines trespassing as a crime. It allows your friends to enter your property without becoming criminals. Your version would make anybody besides the owner a criminal if they were to enter your property for any reason.

If it’s known that the intent of the law is to keep your friends from being trespassers then why is it being used to access other people’s property to hunt?

Seen a wood line painted purple on winnitasca road recently. Never seen that color before
