My takeaways from this thread... 1) Obviously the laws need to be changed... people know dam well they are trespassing nobody should be accepting the line.... "oh, I thought since it wasn't painted purple it was open to the public"... that's just ignorant and ignorant deserves a ticket just the same IMO.
2) got some piddlers on here.

I recently sold some property where the buyer had their own survey made. It didn't match the survey the landowner had made just a few years prior to the sale.
The buyer's surveyor marked a corner one day that was very different from the existing corner that had been established. The next day he came back and moved that corner 38 feet from its previous location. It was still different from the previously established corner of the earlier survey.
When the deed was drawn up for the sale, the legal description on the deed didn't match the surveyor's description. I was scolded by the closing attorney who threatened to call off the sale if I pushed the issue. I'm no surveyor or attorney, but I was taught to read plain English, and the deed of the sale included a parcel of the property that had already been sold years earlier. The buyer's survey didn't include that parcel.
Two corners out of six are matched by the earlier survey and the new survey. Four of the corners are marked in different spots by the two surveys.
I'm glad I'm no longer a part of that mess. New surveying technology doesn't match the old that surveyor's used to use and that's a problem. In addition, lawyers who write legal descriptions are not always paying attention to the details or understanding what they are writing.

If you're directing that accusation at me, let me correct you.
The very reason I know what the law allows and what it doesn't allow is because I was careful to not "pidle" [sic] out of ignorance like you may be doing if you don't educate yourself.
I used to spend time at courthouses finding property boundaries and getting owner information for obtaining permission to hunt before computers made it a lot more convenient and can now be done at home.
I looked up the laws in the local library when they weren't available on computers. I asked for permission to hunt on company owned lands that didn't require permission and found that the law recognizes that as well as the law allowing entry onto unposted property without the need for permission.
So, I've educated myself on the laws and understand why they are written like they are. Your ignorance is showing when you claim those laws need to be changed.

k bush didn't need leo's to warn against trespass for the first offense. The law defines his gate as the warning against trespassing. The trespassers on his property ignored their warning and went around his gate.

Painted mine orange. Ill prosecute trespassers regardless of the paint color. Not a good color to use. That is the color often used by foresters to mark trees to cut or not cut. This might give them a defense in court. My forester suggested orange. They use blue here to mark trees.

Nothing was directed at you in particular... but since you made this statement please explain how it is ignorant on anyone's part to think a law needs to be changed. I certainly don't think that it is "ignorant" to expect those who create such laws to apply common sense. Plainly... people know if they own a piece of property or not... If they are not the owners then the know if they have been granted permission to access said property. AND 100% of the time... they know dam well they are trespassing. Unfortunately the laws have been written in a manner that are proven ineffective and certainly outdated.
No government employees were harmed in the making of this mess.

i think the purple paint is a good idea. I hunt a bunch of different properties every year. Sometimes there isn't a way to tell where one property ends and another begins. Usually everyone is pretty cool with hog doggin in the summertime, but you'll occasionally have someone who has issues. Its usually the guy with > 5 acres. They're usually the worst.
Everyone's different though. Usually if we get out of bounds and they come make contact and figure out we ain't complete renegades, thieves. our dogs won't fool with their livestock or run their deer. And we aint gonna say nothing about their turkey bait, pot plants, mess up their roads, tear down gates, fences, throw out trash, etc. They don't care. Assuming someone in the area has given you permission. Most times they'll check for hog sign and call you or holler at you when they see you and tell you where to look. Once in a blue moon you'll run across the DH that wakes up mad every day and looks for issues. But thats life I reckon.

Purple paint is among the worst colors to use if one is trying to make it visible. It should extend to all colors or at least should be a different color than purple.

There's been cases where both property owners have surveys done , they don't match . They can't agree so both lawyer up and head to the courthouse . The judge orders a third survey and it doesn't match either of the other two.

I donโt know that purple color stands out where Iโve seen it
The way you understood it, Arkansas was kind of open permit back in the late 80s early 90s and purple indicated no trespass. Also I understood Alabama to be posted property no matter what unless given permission.
Purple is suppose for be indicative of no trespass I know GWs wouldnโt write tickets if landowner wouldnโt prosecute. Some wonโt.
Iโve also been told folks think purple indicates trespassers can be shot on site. This was told by known piddlers. LOL

I also confirmed with the Dist. III supervising game warden that I didn't need written permission to hunt the lands of a company who gave me verbal permission to hunt but wouldn't issue a written permit. That fell under the "guest" exclusion of the law requiring written permission to hunt the land of another.
I've been hunting a lot of years guys. Just because I haven't been on the aldeer forum don't mean I don't know what's been going on. I can see that most of you have a lot to learn.

It was his boss who told me that a company could let me hunt their land as a guest without having written permission. I think he'll probably confirm it if you ask him.
