Delta just announced that unvaccinated employees will start paying an extra $200 a month for their insurance. Another discrimination class action just waiting to be filed. Unless they are giving full physicals and adjusting premiums based on age, HBP, smoking, overweight, diabetes, family history of heart disease, cancer or stroke, you cannot legally just pick one specific thing like the vaccine and say, "If you dont get this, youre going to have to pay a higher premium than someone who does get it." I cant believe that Alexander Shahnahnah and his mass tort law buddies havent jumped on this yet. If i am not mistaken, smokers have paid higher medical and life insurance premiums for years. Age makes life insurance go up.....and I was personally denied a life insurance policy at one time for being "morbidly obese" (and am still considered MO by some standards - but im working on it :)) All that said, i am no expert in the laws that regulate this. Whether you smoke or not isn't a question on the health insurance application thru Blue Cross that my company uses. Ours is based off a pool of small businesses and claims across them. The premium is the same doesn't matter if male or female, smoker or non. Blue Cross is not the one passing on the $200 and asking the employee is vaxed or unvaxed. Based on the way Delta is handling it, they are, with almost 100% certainty, self insured on health, and that brings in a whole different set of regulations and requirements that they must follow and fully comply with since they are essentially their own insurance company. Are BCBS, Aetna, Cigna, Humana, United and the other big players in the health insurance markets instituting a premium increase for unvaxed people they insure? No, and you can bet that if they had the data to warrant it, and could legally do it, you'd be seeing it.
