I've known her father for over 20 years. She has an older sister the same age as my oldest daughter. Her mother was my daughters first babysitter. It all hits very close to home. Very tragic. I can't say I wouldn't have done the same thing as the shooters. It's just a bad situation for all involved. Keep all of the families in prayer.
While I never broke in a house or even stole anything for that matter, I did get shot at trying to sneak a girl out of the house as a teenager. One shot hit the radio, one shot hit the dash next to the steering wheel and the other hit the rear quarter panel next to the gas cap. I got real lucky. It could've easily ended the same way or worse.

There are two private parcels of land in the north end of the north creek acording to the Baldwin County Revenue Map. The land is owned by the corps of engineers and is leased, some of the fish camps in the delta are on private land. The camps are privately owned,my boss has a camp in the delta,I personally know one man that has a camp on gravine island,I saw his camp on one of the news stories,I have not talked to him so I don't know if he was involved or not. There has been a problem with break ins lately in this area,so this ain't the first time a camp has been burglarized in this area.

It is private land. There has been one camp there for years and 2 more are now being built. They are not on the River......you have to go up in a slough to get to them.
It was not an 'accident' to launch at Byrnes Lake and wind up at the Camps at 4 am.
TRAGIC no matter the circumstances!!!!

Certainly tragic and she's young and made bad choices. The rate of theft is soaring all across Alabama. I'm in the insurance business and I talk to more customers about theft claims in one week than I used to in 6 months. Folks are sick of it and going forward you can expect shots to be fired more and more often. Not a bad idea to talk to your teenagers about making sure they are not anywhere near such an occurrence.

So...if she dies do they charge the three teenagers with murder since one of their alleged members was killed during the crime? Yes,that's what the news has been saying.
So weird.

Charges have been upgraded against the teen males. Being charged as adults with first degree burglary. They were armed.

So...if she dies do they charge the three teenagers with murder since one of their alleged members was killed during the crime? Maybe according to the law. Depends on what is a participant. If a person is killed by another person during the commission of a dangerous felony, then a murder has occurred. It seems pretty clear that the kids were committing a dangerous felony, therefore, if she dies they may be charged with murder. I would imagine that will depend on how the DA and previous courts view as the participants. Tough for them, but that is the law. Title 13A-6-2(3) in the Alabama Criminal Code reads: (3) He or she commits or attempts to commit arson in the first degree, burglary in the first or second degree, escape in the first degree, kidnapping in the first degree, rape in the first degree, robbery in any degree, sodomy in the first degree, any other felony clearly dangerous to human life and, in the course of and in furtherance of the crime that he or she is committing or attempting to commit, or in immediate flight there from, he or she, or another participant if there be any, causes the death of any person.

So...if she dies do they charge the three teenagers with murder since one of their alleged members was killed during the crime? I believe that would be correct. Saw the same situation on the First 48. Thug that was shooting at someone with other thugs was shot and killed so they charged his thug buddies with 2nd degree murder or man slaughter I think

As Paul Harvey would say - "and now, the rest of the story..." http://blog.al.com/live/2012/04/attorney_describes_gravine_isl.htmlDAPHNE, Alabama -- Campers on Gravine Island shouted and fired warning shots to stop the people captured in their spotlight during what their attorney described as an early morning break-in at a neighboring camp, but they never imagined the nightmare that the 5-minute encounter with 4 teens would launch, according to Daphne attorney Tom Dassinger. Dassinger represents Wayne Hearn, one of six people--3 couples-- who had gone to the remote island in the Mobile-Tensaw Delta for a weekend of fishing, frog-gigging and relaxation. Dassinger said his client does not wish to identify who did the shooting that morning that resulted in 17-year-old Summer Moody being shot in the head, but all the campers have been devastated by the incident. "These were not vigilantes taking justice in their hands," Dassinger said Thursday. "They shouted and fired warning shots trying to get them to stop." Dassinger said the couples were asleep in their camp house when the generator malfunctioned shutting off the air conditioning. "Someone got up to fix it, and it happened again so things were quiet while they were working on it and someone heard a boat motor. Later they heard crashes and people talking. So eventually the men got in a boat and went over." He said the 3 had a spotlight, a .22 rifle and a .17 rifle. When they shined the light toward the camp where the noises were coming from, "they saw what they thought were grown men that turned out to be teenagers." Summer-Moody.jpgView full sizeSummer Moody The campers yelled at the teens to stop and then fired two warning shots as they scattered "to get them to stop" so the campers could call authorities. The campers then returned to their boat and headed away only to hear a young man screaming for help. "One of the teens, Summer Moody's boyfriend, came out carrying Summer to the dock and was screaming for help. The men turned around and went back to help," Dassinger said. They loaded her into their boat and headed for a landing across the river. Dassinger said that 1 of the men "was holding her head and she was bleeding all over, they are trying to get her to talk and raise her hand. This was a nightmare. The events that unfolded couldn't have gone more wrong. It was the worst case of Murphy's Law. But what do you do if you are out there?" Dassinger said the other 2 teens "split. I think her boyfriend stayed at the dock and maybe his friends came back and picked him up later. The campers took Summer on to Cloverleaf Landing to meet help." He said his client and the others are "devastated. But how can you say they did anything wrong? What do you say to Summer's family? They have received threats and they are worried. They don't know what's going to happen. Will they face charges? Will this whole thing just go away? Will there be lawsuits? They were minding their own business camping and in a few minutes times, this happens." Dassinger said the men know which of them fired the shot that hit Summer, though that information has not been disclosed. "There is no winner out of this. Period," he said.

It is a sad situation, but "knowing your target" comes to mind or in this case knowing what is in your line of fire. Shouldn't a warning shot have been fired up toward the sky?
My opinion is that those kids shouldn't have been out there in the first place, though.
It will be interesting to see what, if any, charges are filed against the campers.

Dang.........I don't think what this lawyer says about "The campers yelled at the teens to stop and then fired two warning shots as they scattered "to get them to stop"" will qualify as self defense. Obviously his client didn't fire the shots or else he wouldn't have made this statement. This could pose a big problem for the poor man that did fire the gun.
A whole lot of blame to go around, but it still started due to a stupid act by kids that knew better.
Lord, please help us get our nation straightened out.

the girl is not doing good at all. Less than 1% chance of survival, and if she does make it, then she will probably never recover to function socially.
The shooter could be charged with manslaughter. He fired a weapon, and the barrel was pointed outside the beam of light with an unknown destination. He may not have intended to hit anyone, but he did, and must own up to the responsibility of firing that bullet.
I have been taught that you NEVER fire a weapon unless you know with absolute certainty where the bullet will end up. If you feel you MUST fire a warning shot, then shoot INTO THE GROUND 3' to 5' from your position, but ONLY if you are on soft dirt. NEVER fire into the air and NEVER fire into an area where you cannot identify exactly where your bullet will go.
By firing "into the dark", as a warning, it was sheer (bad) luck that he hit anyone at all.
