My son. Friday night was the business Christmas party. At the end it was announced that their Christmas bonus would be placed into their account at midnight. Son gets up on Saturday sees bonus ($1000) and the bank shows "Funds Available". So he pays his phone bill, utility bill, car insurance and groceries, etc. Goes into work on Monday and has a email from the company that the bonus has been withdrawn. Seems the Owner wants to play Santa Claus and hand each employee a check. So now he (and many other of the employees) are looking at overdraft charges. The owner told them he won't cover the overdraft charges because it wasn't their money to begin with. He can't quit as he and his wife are expecting in February and he needs the insurance.

I'm not sure about legality of it but I know from working at an financial institution that we've had employers recall an automatic deposit for various reasons. Mostly they say it was "Unauthorized" which probably means they had second thoughts about it or "accidentally" hit the send button. If the bank is worth a plug they should waive the fee's without hesitation. At least, most Credit Unions would...

Doesn't he have overdraft protection? If not, is it too late to get it before the charges hit? I'd be pissed too, he will lose a lot good will and team moral. I worked for a small company one time that decided during a budget crunch to give every employee a 1% pay cut. Probably saved the company $20K over a year. They could have just cut loose one C player and doubled that and improved moral. People just don't think sometimes and its all about themselves. Hip Hip Hooray for Me and frak You!
not sure what the best way to handle them is but they shouldnt be on tv and gettn married and raisin kids

Overdraft protection involves of of two things. 1. A separate linked account with sufficient funds to cover any shortage, or 2. They will cover the overdraft for a fee. Depending on how the bank processes the transactions he is looking at 1 to 7 overdraft charges. Since he is considered small potatoes, the bank is not waiving the overdraft fees incurred. He has to wait until the baby is born in February so he won't lose his health insurance.

Owner definitely should have decided how he was going to pay the bonuses before making any announcement and then stick to the decision.

Dang. I'd almost consider taking the bonus, cashing it, then handing in my notice. That's one terrible boss creating a LOT of ill will, just so he can try to look good. What a jackass.

If the employee's account are not at the same institution as the dumbass owner it's not illegal withdrawal of funds. It's the originating institution that would have to prove why it requested the deposit to be recalled (if it made it that far). If the boss sent an e-mail saying it would be deposited that may help but if it was just verbal than there is no way to prove it. Not sure what proving it would do for Texas's son at this point, either. I definitely get the frustration, especially since the bank won't waive the fee's. I'm really surprised by that. It must be one of the big name banks.

Take away 7 overdraft fee's of an average of $35 dollars it's only $700 bonus. Not bad for a Christmas bonus but still sucks to have to pay higher taxes on it and then lose $245 right off the top and still have to pay higher taxes on that amount...

We see more and more of this. What the company did was great. Who wouldn't want a Christmas bonus. But a owner/manager who is clueless and/or out of touch about employee relations messes everything up.
